JUDGMENT OF CHISHOLM J
[1] In this proceeding the plaintiff seeks exemplary damages for invasion of her privacy by virtue of secret filming while she was in the shower. When this proceeding was filed it was accompanied by an ex parte application seeking suppression of the plaintiff’s name. An affidavit in support explains the reasons for the request.
[2] The Court has inherent jurisdiction to make the orders sought: Taylor v Attorney-General.[1] I am satisfied that in the unusual circumstances of this case it is appropriate to permanently suppress the name of the plaintiff and that it is appropriate to make an order on an ex parte basis. There will accordingly be an order permanently suppressing the plaintiff ’s name.
