[1]    The applicants seek final substantive orders settling a remediation scheme under s 74 of the Unit Titles Act 2010 for 955 Mount Eden Road, Three Kings, Auckland, known as Eden Gardens.

[2]    On 3 August 2016 the Weathertight Homes Resolution Service issued a report confirming Eden Gardens is damaged and requires a full re-clad.

[3]    The owners engaged advisers to prepare a design for remediation. A draft scheme was approved without opposition at a general meeting on 27 September 2016. It is unopposed.

[4]    The Court of Appeal has set out a three step process for considering an application to settle such a scheme.1 In accordance with those steps:

(a)I am satisfied Eden Gardens has been damaged, in accordance with the affidavit evidence of Nicholas Batchelor, Building Surveyor.

(b)I consider the proposed reinstatement scheme, including the levy calculation methodology to reflect owners’ benefit, is appropriate in the circumstances.

(c)I approve the terms of the scheme as proposed by the applicants, to be departed from no more than is necessary.

[5]I order the settling of the scheme sought by the applicants.
