ANZ BANK NEW ZEALAND LIMITED v ERASMUS [2013] NZHC 2810 [24 October 2013]

[1]      On 12 August 2013 I ordered summary judgment on the plaintiff’s claim against the defendants.   I reserved the issue of costs to allow the parties to file memoranda.   The plaintiff has  filed a  memorandum  together with  a supporting affidavit seeking an order of costs. The defendants have not filed any opposition.

[2]      I am satisfied on the basis of the material filed by the plaintiff that it is entitled  to  costs  on  a solicitor-client  basis  pursuant  to  the terms  of the parties’ contractual arrangements, and I make an order for costs and disbursements totalling

$15,514 made up as follows:

(a)       $3,500 in legal fees charged on invoice number 900240, dated 16 May

2013.

(b)      $4,014 in legal fees charged on invoice number 900735, dated 3 July

2013.

(c)       $8,000 in legal fees charged on invoice number 900997, dated 13

August 2013.

(d)      A filing fee of $1,155.83.

(e)       A fee for serving the proceedings on the defendants of $235.00.
