JUDGMENT OF THE COURT

[1]       For the reasons discussed with counsel, this application for leave to appeal against the decision of the Employment Court is refused.

[2]       The respondent is entitled to costs of $2,500 and reasonable disbursements, including the travel and accommodation costs of one counsel, to be fixed by the Registrar in the absence of agreement.
