GUMMOW J:   The Court has been notified that there will be no appearance in this matter and the Court has determined the application for special leave on the written submissions.

There will be a grant of special leave in this matter.  However, the grant will be a limited one.  The limitation is with respect to ground 2(b) on page 120 of the application book.  That ground raises the point which might be briefly described as the Edwards v The Queen point.  There will be a grant of leave as so limited.

We will take a short adjournment.
