(Offences) Regulation 1999

Young Offenders Act 1997

His Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Young Offenders Act 1997.

Explanatory note
The object of this Regulation is to prescribe certain offences under the Summary Offences Act 1988 with the effect that an investigating official dealing with any such offence must consider whether to deal with the offence under the Young Offenders Act 1997 instead of issuing a penalty notice for the offence. The Young Offenders Act 1997 provides for the issuing of warnings and cautions and for youth justice conferences to be held to deal with offences. The offences prescribed are under section 11C (relating to having custody of a knife in a public place or school) and under section 28F (relating to failing to comply with a reasonable direction of a police officer).
This Regulation is made under the Young Offenders Act 1997, including section

9 (2A) and section 73 (the general regulation-making power).

2 Commencement

This Regulation commences on 17 December 1999.

3 Amendment of Young Offenders Regulation 1997

The Young Offenders Regulation 1997 is amended as set out in

Schedule 1.

21      Penalty notice offences subject to young offenders scheme

For the purposes of section 9 (2A) of the Act, the following offences are prescribed as offences in respect of which an investigating official must consider the matters referred to in section 9 (2) (a) and (b) of the Act before issuing a penalty notice:

(a)

offences under section 11C of the Summary Offences Act 1988,

(b)

offences under section 28F of the Summary Offences Act 1988.
