1. This application requires an extension of time.  The proposed appeal concerns a matter of practice and procedure.  It does not enjoy sufficient prospects of success to warrant the grant of special leave to appeal.  It would therefore be futile to grant an extension of time, and the application for the extension is refused.

2. Pursuant to r 41.08.1, we direct the Registrar to draw up, sign and seal an order dismissing the application for special leave to appeal.
