KIEFEL CJ:   The parties to this proceeding filed a consent on 1 November 2017 to the making of orders disposing of the proceeding.  The Court makes the following orders by consent:

1.The appellant have leave to bring the first proposed ground of appeal contained at paragraph 2 of the notice of appeal filed in this proceeding on 19 May 2017.

2.        Appeal allowed with costs.

3.Set aside the order of the Supreme Court of Nauru made on 5 May 2017 and in its place order that:

(a)the decision of the Refugee Status Review Tribunal made on 22 May 2015 be quashed, and

(b)the matter be remitted to the Review Status Review Tribunal for reconsideration.
