KIEFEL CJ:   The parties to this proceeding filed a consent on 2 November 2017 to the making of orders disposing of the proceeding.  The Court makes the following orders by consent:

1.        Appeal allowed with costs.

2.Set aside the order of the Supreme Court of Nauru made on 31 May 2017 and in its place order that:

(a)the decision of the Refugee Status Review Tribunal made on 22 May 2015 be quashed, and

(b)the matter be remitted to the Refugee Status Review Tribunal for reconsideration.
