An Act to enable the Trustees of certain allot- ments in the Town of Yass granted to Henry O'Brien and others as Trustees of the Roman Catholic Church at Yass to sell a portion of the said land and to provide for the application of the proceeds thereof.

Trustees as aforesaid A n d whereas t h e lands described in t h e Schedule hereto be ing a port ion of t he lands comprised in t h e said five deeds of g ran t a re n o t required as a site for a R o m a n Catholic Church nor for

t he en la rgement of t h e present site of t h e R o m a n Catholic Church in

the town of Yass A n d whereas t h e said R i g h t Reverend W i l l i a m

Lan igan Reve rend Pa t r i ck D u n n e and M o r g a n O'Connor as such Trustees as aforesaid are desirous of selling t h e said lands described in t he said Schedule here to and of apply ing t h e proceeds of such sale in or towards t he erection ma in tenance and support of a R o m a n Catholic School or Schools and Teacher ' s residence or residences in t he Town of Yass or in or towards t h e purchase for t h a t purpose of a bui ld ing or bui ldings in t he said Town Be i t therefore enacted by the Queen ' s Most Exce l len t Majesty by and wi th t he advice and consent of t h e Legislat ive Counci l and Legislat ive Assembly of N e w South Wales in Pa r l i amen t assembled and by t h e au thor i ty of t h e same as follows :—

1. F rom and after t he passing of this A c t i t shall be lawful for t h e said R i g h t Reverend Wi l l i am Lan igan Reverend Pa t r i ck D u n n e and Morgan O'Connor as such Trustees as aforesaid the i r heirs or assigns to sell and dispose of t h e said lands described in t h e Schedule here to by publ ic auct ion or by pr ivate contract and e i ther in one lot or in several lots as t hey shall deem expedient for such price or prices as can be reasonably obtained for t he same and to convey and assure
t he same or any pa r t or par t s thereof w h e n sold to t he purchaser or
purchasers thereof in fee s imple freed and discharged from all t rus ts

affecting t h e same lands A n d the receipt in wr i t ing of t h e said Trustees the i r heirs or assigns for t h e purchase moneys ar is ing from such sale or sales shall be a sufficient discharge to t he purchaser or purchasers of t h e said lands and shall exonerate h im her or t h e m from seeing to t he appl icat ion of t he said moneys and from all l iabili ty in respect of t he mis-appl icat ion or non-appl icat ion thereof.

2. The said Trustees the i r heirs or assigns shall s tand possessed of t he moneys arising from such sale or sales as aforesaid upon t rus t to apply t h e proceeds thereof in or towards t h e erection main tenance and suppor t of a R o m a n Catholic School or Schools a n d Teacher 's residence or residences in t he Town of Yass or in or towards t h e purchase for t h a t purpose of a bui ld ing or bui ldings in t he said town A n d t h e receipts of any person or persons to w h o m any moneys shall be paid by t h e said Trustees the i r heirs or assigns unde r t he provisions of th is A c t shall be a valid and complete discharge to t he said Trus tees the i r hei rs or assigns for such moneys .

THE SCHEDULE.

1. All that allotment or parcel of land in the Colony of Now South Wales containing by admeasurement two roods situated in the town of Yass parish of Yass county of Murray allotment number eight of section number seventeen Bounded on the south-west by a line bearing north-west two chains fifty links commencing at the cast corner of allotment number seven on the north-west by a line bearing north-east two chains on the north-east by two chains fifty links of the south-west side of Comur- street bearing south-east and on the south-east by two chains of the north-west side of Meehan-street bearing south-west to the east corner of allotment number seven aforesaid being the allotment sold as lot eighty in pursuance of the advertisement of thirty-first August one thousand eight hundred and thirty-nine.

2. All that allotment or parcel of land in the Colony of New South Wales con- taining by admeasurement two roods situated in the town of Tass parish of Yass county of Murray allotment number nine of section number seventeen Bounded on the south-east by a line bearing south-west two chains commencing at the north corner of allotment number eight on the south-west by a line bearing north-west two chains fifty links on the north-west by a line bearing north-east two chains and on the north-east by two chains fifty links of the south-west side of Comur-street bearing south-east to the north corner of allotment number eight aforesaid being the allotment sold as lot eighty- one in pursuance of the advertisement of thirty-first August one thousand eight hundred and thirty-nine.

All that allotment or parcel of land in the Colony of New South Wales con- taining by admeasurement two roods situated in the town of Yass parish of Yass county of Murray allotment number ten of section number seventeen Bounded on the south-east by a line bearing south-west two chains commencing at the north corner of allotment number nine on the south-west by a line bearing north-west two chains fifty links on the north-west by a line bearing north-east two chains and on the north-east by two chains fifty links of the south-west side of Comur-street bearing south-east to the corner of allotment number nine aforesaid being the allotment sold as lot eighty-two in pursuance of the advertisement of thirty-first August one thousand eight hundred and thirty-nine.
