An Act to enable portions of the Yarra Park in the City of Melbourne to be used for the purposes of a Road.

Preamble

WHEREAS Yarra Park in the City of Melbourne was by the Governor in Council permanently reserved from sale and granted unto and vested[1] in the Board of Land and Works and the Mayor Aldermen Councillors and Citizens of the City of Melbourne and their successors to be maintained and used as and for a Public Park and offices and conveniences connected therewith:

AND WHEREAS it is expedient that a roadway for vehicular traffic be constructed in the said park from the junction of Jolimont-terrace and Jolimont-street in the said city to the Melbourne Cricket Ground:

BE IT THEREFORE ENACTED by the Queen's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say):

1.Short title

This Act may be cited as the Yarra Park Road Act 1897.

2.Construction of roadway to Melbourne Cricket Ground not a breach of Crown grant

Notwithstanding anything contained in the Crown grant of the said park the construction of the roadway hereinbefore referred to shall not be deemed to be a breach of the terms and conditions of the Crown grant vesting the said park in the said Board and the said Mayor Aldermen Councillors and Citizens; and the right and title of the said Board and the said Mayor Aldermen Councillors and Citizens to the said park shall not in any way be prejudiced or affected by reason of the construction of such roadway.

3.When roadway to be kept open

That such roadway shall at all times be kept open for such vehicular traffic except during such times and so long only as the said Board of Land and Works and the said Mayor Aldermen Councillors and Citizens shall jointly be of the opinion that the said roadway shall be closed.
