COMPANY, LIMITED, ACT AMENDMENT [ASSENTED TO 7TH OCTOBER, 1958.] ACT OF 1958. B E it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legis- lative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :- Short title. 1. (1.) This Act may be cited as " The Wynnum and Manly Gas and Lighting Company, Limited, Act Amendment Act of 1958." Principal (2.) *" The Wynnum and Manly Gas and Lighting Act. Company, Limited, Act of 1912," is in this Act referred to as the Principal Act. Collective (3.) The Principal Act and this Act may be title. collectively cited as " The Wynnum and Manly Gas and Lighting Company, Limited, Acts, 1912 to 1958." Amendments 2. Section forty-four of the Principal Act is of s. 44. amended— (a) By repealing the definition "Corporation of the Shire of Wynnum " ; and * 3 G. 5.

The following sections are inserted after section New ss. 44A forty-four of the Principal Act, namely :— and 44B inserted. " [44A.] Nothing in this Act or in the memorandum and articles of association of The Wynnum and Manly Gas and Lighting Company, Limited, shall authorise, or be deemed to authorise, that company to supply gas, or to exercise any of the powers conferred upon it by sections eleven, twelve, thirteen, fourteen and fifteen of this Act, outside the Area set out in the Schedule to this Act. in Co[ 4u4nBc. i]l m (1. a ) ySfurobmjetcitmteo ttohitismsee, cbtiyonO, rdtheer iGn oCvoeurnncoirl g Po oo, w vine e er r ri s lio o : f m . published in the Gazette, amend the Schedule to this Act— (a) By excluding from the Area set out therein any part of that Area; or (b) By including in the Area set out therein any other area not already included in that Area, and the said Schedule as so amended shall thereupon become for the time being the Schedule to this Act and shall have effect accordingly. (2.) The Governor in Council shall not, pursuant to this section, exclude from the Area set out in the Schedule to this Act any part of that Area, or include in that Area any area not already included therein, save with the prior consent in writing of The Wynnum and Manly Gas and Lighting Company, Limited. (3.) The Governor in Council shall not, pursuant to this section, include in the Area set out in the Schedule to this Act any area not already included therein wherein any person or company other than The Wynnum and Manly Gas and Lighting Company, Limited is authorised under an Act to supply gas save with the prior consent in writing of that person or company.

For the purposes of this subsection a company or person shall be deemed to be not authorised by an Act to supply gas in an area which is not expressly set out in the Act in question." 4. The following Schedule is added to the Principal Act, namely :— "SCHEDULE. BOUNDARIES OF THE AREA. Commencing at a point on the southern bank of the Brisbane River at the mouth; thence along the southern bank of the Brisbane River in a south-westerly direction to the mouth of Bulimba Creek ; thence along the eastern bank of Bulimba Creek in a southerly direction to the intersection of Bulimba Creek and Boundary street; thence along the eastern side of Boundary street in a southerly direction to the intersection of Boundary street and Wynnum road; thence along the northern side of Wynnum road in an easterly direction to the intersection of Wynnum road and New Cleveland road; thence along the northern side of New Cleveland road in an easterly direction to the intersection of New Cleveland road and Manly road; thence along the eastern side of New Cleveland road in a generally southerly and easterly direction to the intersection of New Cleveland road and Capalaba road; thence along the northern side of Capalaba road in a south-easterly direction to the intersection of Capalaba road and Finucane road; thence along the northern side of Finucane road in an easterly direction to the intersection of Finucane road and Hilliards Creek; thence along the western bank of Hilliards Creek in a northerly direction to the mouth of Hilliards Creek; thence along the foreshores of Moreton Bay at high water mark in a generally northerly direction to the commencing point on the southern bank of the Brisbane River at the mouth."
