Application for approval of the Wyndham Clinic and the Australian Nursing Federation Nurses Enterprise Agreement 2013 - Greenfields Agreement.

[1] An application has been made for approval of an enterprise agreement known as the Wyndham Clinic and the Australian Nursing Federation Nurses Enterprise Agreement 2013 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). It is a greenfields agreement.

[2] The Agreement was made by the employer, Wyndham Clinic and the Australian Nursing Federation.

[3] I am satisfied that each of the requirements of ss.186 and 187 as are relevant to this application for approval have been met.

[4] I am also satisfied for the purposes of s.187(5) of the Act that the union, the employee organisation covered by the Agreement, is entitled to represent the industrial interests of a majority of the employees to be covered by the Agreement, and that it is in the public interest to approve the Agreement.

[5] The Agreement is approved and, in accordance with s.54, will operate from 9 July 2013. The nominal expiry date of the Agreement is 30 June 2016.
