  1. The applicant is granted an extension of time in which to seek special leave to appeal from a judgment of the Court of Appeal of the Supreme Court of New South Wales (Stern JA, Gleeson and Mitchelmore JJA agreeing), dismissing the applicant's appeal from a decision of the Supreme Court of New South Wales (Basten AJ).

  2. The proposed appeal however does not enjoy sufficient prospects of success or raise a question of law of general importance sufficient to warrant the grant of special leave to appeal.

  3. Special leave to appeal is refused with costs.
