World Heritage (Western Tasmania Wilderness) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulation under section 69 of the National Parks and Wildlife Conservation Act 1975.

Protection of cultural and natural heritage

Regulation 5 of the World Heritage (Western Tasmania Wilderness) Regulations is amended by omitting sub-regulation (3) and substituting the following sub-regulations:

“(3) Where—

(a) within an area to which these Regulations apply, a person does an act referred to in sub-regulation (1) without the consent of the Minister; and

(b) the controller of that area or of the relevant part of that area has failed to take reasonable steps to prevent the doing of the act,

the controller of that area or of the relevant part of that area, as the case may be, is guilty of an offence and is punishable upon conviction by a fine not exceeding $5,000.

“(4) For the purposes of sub-regulation (3), a person is the controller of an area or of a part of an area if the person is—

(a) the person in whom that area or part is vested; or

(b) if the person in whom that area or part is vested is not the occupier of that area or part—the person who is the occupier of that area or part, as the case may be.”.
