World Heritage Properties Conservation Regulations (Amendment) (Cth)

GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of
the Federal Executive Council, hereby make the following Regulations under the
Dated 25 July 1990.

1.1 The World Heritage Properties Conservation Regulations are amended as set out in these Regulations.
Insert after Regulation 3D:
“3E. (1) In this Regulation:
‘native plants’ means:
(a) plants that are indigenous to Australia; and
(b) plants of a kind introduced into Australia, directly or indirectly, by Aboriginals before the year 1788;
‘plant’ means any member, alive or dead, of the plant kingdom or the fungus kingdom, and includes seeds and parts of plants;
‘relevant property’ means the property described in Schedule 2C.

“(2) For the purposes of subsection 9 (1) of the Act, each of the following acts is prescribed in relation to the relevant property:
(a) killing, removing or damaging a native plant;
(b) disturbing soil in such a way as to damage a native plant;
(c) permitting, authorising, directing or ordering, or purporting to permit, authorise, direct or order, the doing of an act of a kind referred to in paragraph (a) or (b);
other than acts of the kind referred to in those paragraphs that involve:
(d) traditional activities of Aboriginal people; or
(e) activities performed by Aboriginal people for their own use.”.

All that piece of land in the State of Queensland County of Cardwell Parish of Rockingham being the whole of the land in Lot 640 on Plan Cat. No. CWL3521.
