An Act to amend workplace legislation

The Legislative Assembly for the Australian Capital Territory enacts as follows:

Part 1Preliminary

1. Name of Act

   This Act is the Workplace Legislation Amendment Act 2025.

2. Commencement

   (1)This Act (other than part 5) commences on the 7th day after its notification day.

   NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

   (2)Part 5 commences on the later of—

   (a)1 July 2025; and

   (b)the day after this Act’s notification day.

3. Legislation amended

   This Act amends the following legislation:

   ·     Government Procurement Act 2001

   ·     Labour Hire Licensing Act 2020

   ·     Long Service Leave (Portable Schemes) Act 2009

   ·     Workers Compensation Act 1951

   ·     Work Health and Safety Act 2011.

Part 2Government Procurement Act 2001

1. Membership of council
   Section 22ZB (3) and (4)

   substitute

   (3)The registrar is—

   (a)the chair of the council; and

   (b)a non-voting member of the council.

Part 3Labour Hire Licensing Act 2020

1. Membership of committee
   Section 21 (3) and (4)

   substitute

   (3)The commissioner is—

   (a)the chair of the committee; and

   (b)a non-voting member of the committee.

Part 4Long Service Leave (Portable Schemes) Act 2009

1. New section 48A

   in part 5, insert

48AMeaning of quarter

In this Act—

quarter means—

(a)if, for a particular employer, a period is agreed between the registrar and the employer—the period; or

(b)in any other case—a period of 3 months beginning on 1 January, 1 April, 1 July or 1 October in any year.
