Workplace Health and Safety and Another Regulation Amendment Regulation (No. 1) 2009 Part 1 Preliminary [s 1] Part 1 Preliminary 1 Short title This regulation may be cited as the Workplace Health and Safety and Another Regulation Amendment Regulation (No. 1) 2009 . 2 Commencement (1) Section 21 commences on 1 September 2009. (2) The remaining provisions of this regulation commence on 1 July 2009. Part 2 Amendment of Workplace Health and Safety Regulation 2008 3 Regulation amended This part amends the WorkplaceHealthandSafetyRegulation 2008. 4 Amendment of s 16 (Meaning of assessment instrument ) Section 16(1)— omit, insert— ‘(1) Assessment instrument , for a unit of competency for a class of high risk work, means— (a) before 1 July 2010— (i) the instrument for the unit of competency, issued by the chief executive, that relates to what is to be assessed for the unit of competency, how the 2009 SL No. 128 Page 4
Workplace Health and Safety and Another Regulation Amendment Regulation (No. 1) 2009 Part 2 Amendment of Workplace Health and Safety Regulation 2008 [s 5] assessment must be conducted and recording of the assessment results; or (ii) the nationally approved assessment instrument under the national standard; or (b) on or after 1 July 2010—the nationally approved assessment instrument under the national standard.’. 5 Amendment of s 17 (Meaning of unit of competency ) Section 17(1)— omit, insert— ‘(1) Unit of competency , for a class of high risk work, means— (a) before 1 July 2010— (i) the unit of competency stated in schedule 5 for the class of high risk work; or (ii) the unit of competency, under the national standard, that is stated in schedule 5A for the class of high risk work; or (b) on or after 1 July 2010—the unit of competency, under the national standard, that is stated in schedule 5A for the class of high risk work.’. 6 Amendment of s 18 (Authority to perform high risk work) (1) Section 18(5)(d)(iii)(A), ‘training approval’— omit, insert— ‘training and assessment approval’. (2) Section 18(8)— omit, insert— ‘(8) Subsection (1) does not apply to a worker, and subsection (2) does not apply to a person, in relation to high risk work that is the work of a dogger if— Page 5 2009 SL No. 128
Workplace Health and Safety and Another Regulation Amendment Regulation (No. 1) 2009 Part 2 Amendment of Workplace Health and Safety Regulation 2008 [s 7] (a) the worker or person holds the licence class operator of a vehicle loading crane and— (i) the load being lifted is lifted from the ground onto the vehicle on which the crane is mounted, or from the vehicle onto the ground; and (ii) the load being lifted is lifted within the view of the worker or person; or (b) the worker or person holds an earthmoving or particular crane work certificate for the occupation operator of a bridge and gantry crane in the circumstances mentioned in schedule 6, section 1(1)(a) and (b), and the load being lifted is lifted within the view of the worker or person.’. 7 Amendment of s 25 (Authority to perform work in an earthmoving or particular crane operation) (1) Section 25(3)(h)— omit, insert— ‘(h) the person holds evidence of competency that— (i) is attained in another State; and (ii) complies with former NOHSC document entitled ‘National Guidelines for Occupational Health and Safety Competency Standards for the Operation of Loadshifting Equipment and Other Types of Specified Equipment [NOHSC:7019 (1992)].’. (2) Section 25(4)(d)(iii)(A), ‘training approval’— omit, insert— ‘training and assessment approval’. (3) Section 25(6) and (7)— omit, insert— ‘(6) Subsection (1) does not apply to a worker, and subsection (2) does not apply to a person, in relation to work that is the operation of a bridge and gantry crane in the circumstances mentioned in schedule 6, section 1(1)(a) and (b), if the worker 2009 SL No. 128 Page 6

(2) Section 50(2)— renumber as section 50(3). (3) Section 50— insert— ‘(2) The holder of a certificate to perform a prescribed activity must give the chief executive written notice of a change in the competent person for a prescribed activity within 14 days after the change. Maximum penalty—10 penalty units.’. 9 Amendment of s 62 (Registered training organisation’s duty for assessing competency) Section 62— insert— ‘(2) A registered training organisation must ensure each person who trains or assesses the competency of a person in the general induction training course complies with the requirements of— (a) the Vocational Education, Training and Employment Act2000 in relation to the training or assessment; and (b) any agreement entered into by the registered training organisation for the training or assessment.
