s1 2 s3 Workplace Health and Safety Amendment Regulation No. 290, 2002 (No. 7) 2002 1 Short title This regulation may be cited as the Workplace Health and Safety Amendment Regulation (No. 7) 2002 . 2 Regulation amended This regulation amends the WorkplaceHealthandSafetyRegulation1997 . 3 Amendment of s 69A (Application of div 1) Section 69A— insert (2) However, this division does not apply to— (a) a place used for domestic residential purposes; or (b) a place that is, or is in the nature of, common property if the common property serves only places used for domestic residential purposes; or (c) a workplace forming part of a place used for domestic residential purposes. Examples for subsection (2) 1. This division does not apply to a house, or a block of units or townhouses, used for domestic residential purposes. 2. This division does not apply to a house used for domestic residential purposes even though an employer or self-employed person operates a small business from a part of the house. 3. If some places in a building are used for domestic residential purposes, and other places are used as shops and restaurants, this division does not apply to the places used for domestic residential purposes. Further, this division does not apply to places in the building that are, or are in the nature of, common property if those places serve only the places used for domestic residential purposes. However, this division does apply to the places in the building that are, or are in the nature of, common property if those places serve the shops and restaurants. 4. A building is clearly differentiated into 2 sections. The front section of the building is operated as a shop, and the rear section is used for domestic residential purposes. This division would apply to the part of the building that is the shop but not to the part of the building that is used for domestic residential purposes. ’. ENDNOTES
