This regulation may be cited as the Workplace Health and Safety Amendment Regulation (No. 6) 1996 . ˙ Regulation amended 2. This regulation amends the Workplace Health and Safety Regulation1995 . ˙ Amendment of s 72 (Definitions for pt 15) 3. Section 72, definition “electrical equipment” — omit, insert— ‘ “electrical equipment” — (a) means any of the following things designed for low voltage electrical operation— (i) appliance connector; (ii) cord extension socket; (iii) earth monitoring device; (iv) electrical socket outlet adaptor; (v) extension lead; (vi) flexible cable; (vii) isolating transformer; (viii)plug; (ix) portable electrical equipment; (x) residual current device; and (b) for sections 75, 76 and 87— (i) includes second-hand portable electrical equipment used for demonstration purposes; but
s4 3 s4 Workplace Health and Safety Amendment (No. 6) No. 427, 1996 (ii) does not include the following— (A) double adaptors; (B) hire electrical equipment; (C) other portable electrical equipment used only for demonstration purposes.’. ˙ Replacement of ss 75 and 76 4. Sections 75 and 76— omit, insert— ˙ ‘ Using electrical equipment other than in assembly, fabrication, maintenance, manufacturing or repair work ‘ 75.(1) This section applies to electrical equipment that is not used in assembly, fabrication, maintenance, manufacturing or repair work at a workplace. Example of work this section applies to— Cleaning a motel, retailing in a shop or clerical work in an office. ‘ (2) An employer or self-employed person must ensure electrical equipment is not used at the employer’s or self-employed person’s workplace unless it is— (a) inspected and tested by an electrical worker under AS 3760—1990 (other than clause 2.4.2.2); or (b) protected by a type 1 or 2 safety switch complying with AS 3190—1994. Maximum penalty—30 penalty units. ‘ (3) If the equipment complies with AS 3760—1990 (other than clause 2.4.2.2), the employer or self-employed person must ensure— (a) the electrical worker, immediately after inspecting and testing the electrical equipment, attaches a durable tag to it within 300 mm of its plug; and
s4 4 s4 Workplace Health and Safety Amendment (No. 6) No. 427, 1996 (b) the tag shows— (i) the day by which the electrical equipment must be reinspected and retested; and (ii) the electrical worker’s licence or permit number under the Electricity Act 1994 . Maximum penalty—30 penalty units. ˙ ‘ Using electrical equipment in assembly, fabrication, maintenance, manufacturing or repair work ‘ 76.(1) This section applies to electrical equipment used in assembly, fabrication, maintenance, manufacturing or repair work at a workplace. Example— At a workplace where clothes are manufactured, this section— (a) applies to electrical equipment used by the workers to make the clothes; but (b) does not apply to electrical equipment used by the workers to make their coffee. ‘ (2) An employer or self-employed person must ensure electrical equipment is not used at the employer’s or self-employed person’s workplace unless— (a) it is inspected and tested by an electrical worker under AS 3760—1990 (other than clause 2.4.2.2); and (b) for portable electrical equipment— (i) it is double insulated; or (ii) it is connected to 1 of the following— (A) a type 1 or 2 safety switch complying with AS 3190—1994; (B) an isolating transformer complying with AS 3108—1994; (C) an earth monitoring device. Maximum penalty—30 penalty units.
s5 5 s5 Workplace Health and Safety Amendment (No. 6) No. 427, 1996 ‘ (3) If the equipment complies with AS 3760—1990 (other than clause 2.4.2.2), the employer or self-employed person must ensure— (a) the electrical worker, immediately after inspecting and testing the electrical equipment, attaches a durable tag to it within 300 mm of its plug; and (b) the tag shows— (i) the day by which the electrical equipment must be reinspected and retested; and (ii) the electrical worker’s licence or permit number under the Electricity Act 1994 . Maximum penalty—30 penalty units.’. ˙ Replacement of s 87 (Safety switch or isolating transformer for low voltage equipment) 5. Section 87— omit, insert— ˙ ‘ Using electrical equipment ‘ 87.(1) An employer or self-employed person must ensure electrical equipment is not used unless— (a) it is inspected and tested by an electrical worker under AS 3760—1990 (other than clause 2.4.2.2); and (b) for equipment being used for construction work without construction wiring—if it is connected to— (i) a type 2 safety switch complying with AS 3190—1994; or (ii) an isolating transformer. Maximum penalty—30 penalty units. ‘ (2) If the equipment complies with AS 3760—1990 (other than clause 2.4.2.2), the employer or self-employed person must ensure— (a) the electrical worker, immediately after inspecting and testing the electrical equipment, attaches a durable tag to it within 300 mm of its plug; and
s5 6 s5 Workplace Health and Safety Amendment (No. 6) No. 427, 1996 (b) the tag shows— (i) the day by which the electrical equipment must be reinspected and retested; and (ii) the electrical worker’s licence or permit number under the Electricity Act 1994 . Maximum penalty—30 penalty units. ‘ (3) The employer or self-employed person must ensure the safety switch is tested— (a) using its inbuilt test button— (i) immediately after it is connected to a socket outlet; and (ii) immediately before it is used for the first time on each day of use; and (b) by an electrical worker at not more than 1 yearly intervals. Maximum penalty—30 penalty units. ‘ (4) The employer or self-employer person may use the safety switch only if— (a) when tested under subsection (3)(a), it trips immediately; or (b) when tested under subsection (3)(b), it trips immediately and has a residual current trip of 30 mA.
