s1 3 s5 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 1 Short title This regulation may be cited as the Workplace Health and Safety Amendment Regulation (No. 4) 2003 . 2 Commencement (1) Sections 3 to 7 and 9 commence on 31 December 2003. (2) Section 8 commences on 1 February 2004. 3 Regulation amended This regulation amends the WorkplaceHealthandSafetyRegulation 1997. 4 Amendment of pt 11, div 3, hdg Part 11, division 3, heading— omit, insert— ‘Division 3—Prohibitions on particular activities involving asbestos ’. 5 Replacement of ss 75A and 75B Sections 75A and 75B— omit, insert— ‘75A Prohibition for employers—particular activities involving asbestos ‘ (1) An employer must not— (a) use or allow a worker to use a power tool to clean an asbestos product; or Examples of paragraph (a) — • using an electric sander to clean asbestos-cement sheeting before painting it • using an electric wire brush to remove an asbestos gasket from plant.
s5 4 s5 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 (b) use or allow a worker to use a high pressure water process to clean an asbestos product or to clean up debris from an asbestos product; or Examples of paragraph (b) — • using a water blaster to clean an asbestos-cement sheeting roof • using a water blaster to clean up debris left after removing an asbestos-cement sheeting roof. (c) use or allow a worker to use compressed air to clean— (i) an asbestos product; or Example of compliance with subparagraph (i) — Vehicle brake or clutch systems fitted with parts containing asbestos may be cleaned using a vacuum cleaner suitable for use with asbestos dust rather than blowing the dust away with compressed air. (ii) a surface where debris from an asbestos product is present. Example of subparagraph (ii) — Using compressed air to blow dust from clothing after working with asbestos-cement sheeting. ‘ (2) Subsection (1) is a workplace health and safety obligation for the Act. Note— See section 24 1 of the Act for the penalty for failing to discharge a workplace health and safety obligation. ‘75B Prohibition for self-employed persons—particular activities involving asbestos ‘ (1) A self-employed person must not— (a) use a power tool to clean an asbestos product; or (b) use a high pressure water process to clean an asbestos product or to clean up debris from an asbestos product; or (c) use compressed air to clean— (i) an asbestos product; or (ii) a surface where debris from an asbestos product is present. 1 Section 24 (Discharge of obligations) of the Act
s6 5 s7 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 ‘ (2) Subsection (1) is a workplace health and safety obligation for the Act. Note— See section 24 2 of the Act for the penalty for failing to discharge a workplace health and safety obligation.’. 6 Replacement of s 111 (Keeping registers) Section 111— omit, insert— ‘111 Keeping register ‘ (1) An employer or self-employed person at a workplace must keep a register at the workplace containing— (a) a list of all hazardous substances used at the workplace; and (b) the current MSDS for each substance. Maximum penalty—30 penalty units. ‘ (2) The employer must allow the employer’s workers who may be exposed to a hazardous substance at the workplace to inspect the register at any reasonable time. Maximum penalty—30 penalty units. ‘ (3) This section does not apply to a retailer or retail warehouse operator if the hazardous substance is contained in a consumer package that will not be opened on the retailer’s or operator’s premises.’. 7 Amendment of s 114 (Prohibited substances) Section 114, heading and subsection (1)— omit, insert— ‘114 Prohibited substances and asbestos products ‘ (1) An employer or self-employed person must ensure a prohibited substance or prohibited asbestos product mentioned in schedule 7 3 is not 2 Section 24 (Discharge of obligations) of the Act 3 Schedule 7 (Prohibited substances and asbestos products and prohibited purposes)
s8 6 s8 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 used for a prohibited purpose mentioned in that schedule for the substance or product at the employer’s or self-employed person’s workplace.’. 8 Replacement of sch 1 (Fees) Schedule 1— omit, insert— ‘SCHEDULE 1 ‘FEES section 4 ‘1 Registration, or renewal of registration, of registrable workplace ‘ (1) This section sets the fee for registration, or renewal of registration, of a registrable workplace. ‘ (2) If the main activity at the workplace is classified in schedule 2 as category 2 or 3 and more than 2 persons are employed between 1 February of the year and 31 January of the next year, the fee is— (a) $34.60; and (b) for each person, after the first 2 persons, employed at any time during the period— (i) for a category 2 workplace—$10.30; or (ii) for a category 3 workplace—$16.50. ‘ (3) In this section— “person” employed includes the employer, a self-employed person and a person employed part time or full time. ‘2 Notification of building and construction work ‘ (1) This section sets the fee for the notification of building and construction work. ‘ (2) The fee is 0.125% of the cost of the building and construction work.

s 9 12 s 9 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 omit, insert— ‘SCHEDULE 7 ‘PROHIBITED SUBSTANCES AND ASBESTOS PRODUCTS AND PROHIBITED PURPOSES section 114 ‘1 Amosite, crocidolite, fibrous anthophyllite, tremolite or actinolite ‘ (1) Amosite, crocidolite, fibrous anthophyllite, tremolite and actinolite are prohibited substances. ‘ (2) A thing containing amosite, crocidolite, fibrous anthophyllite, tremolite or actinolite is a prohibited asbestos product. ‘ (3) The prohibited purpose for the prohibited substances or the prohibited asbestos product is a purpose other than any of the following— (a) analysis, research or sampling; (b) maintenance; (c) removal or disposal; (d) encapsulation or enclosure. ‘2 Chrysotile ‘ (1) Chrysotile is a prohibited substance. ‘ (2) A thing, other than a product or item exempted under the national model regulations, containing chrysotile is a prohibited asbestos product. ‘ (3) The prohibited purpose for chrysotile is a purpose other than— (a) analysis, research or sampling; or (b) removal or disposal. ‘ (4) The prohibited purpose for the prohibited asbestos product mentioned in subsection (2) is a purpose other than any of the following— (a) analysis, research or sampling;
s 9 13 s 9 Workplace Health and Safety Amendment Regulation No. 235, 2003 (No. 4) 2003 (b) removal or disposal; (c) display of an artefact or other thing that is, or forms part of, the prohibited asbestos product, or work to prepare or maintain the artefact or thing for display; Examples of an artefact or other thing for paragraph (c) — • a locomotive, steam engine or vehicle in a museum or historical display • an artefact that is an ornament. (d) to use the prohibited asbestos product in the position where it was installed immediately before 31 December 2003; Examples — • to use brake shoes, containing chrysotile, installed in a car before 31 December 2003 • to paint, or cut a hole in, an asbestos-cement wall panel, containing chrysotile, installed before 31 December 2003. (e) to reinstall the prohibited asbestos product in the position where it was installed immediately before 31 December 2003; Example — To reinstall an asbestos-cement wall panel or arc shield, containing chrysotile, in the position where it was installed immediately before 31 December 2003. ‘ (5) In this section— “national model regulations” means NOHSC’s document entitled ‘National Model Regulations for the Control of Workplace Hazardous Substances [NOHSC:1005]’, schedule 2.’.
