Workplace Health and Safety Amendment Regulation (No. 1) 2011 [s 1] 1 Short title This regulation may be cited as the Workplace Health and Safety Amendment Regulation (No. 1) 2011 . 2 Regulation amended This regulation amends the WorkplaceHealthandSafetyRegulation 2008. 3 Amendment of s 54 (Term of certificate) Section 54— insert — ‘ Note — See sections 376 and 377.’. 4 Amendment of s 57 (Application for certificate of authority of appointment) Section 57(4)— insert — ‘ Note — See sections 378 and 379.’. 5 Insertion of new pt 28, div 10 After section 375— insert — Page 2 2011 SL No. 55

Workplace Health and Safety Amendment Regulation (No. 1) 2011 [s 5] ‘Division 10 Transitional provisions for Workplace Health and Safety Amendment Regulation (No. 1) 2011 ‘376 Particular bonded asbestos removal certificates to end 31 December 2012 ‘(1) This section applies to a bonded asbestos removal certificate if— (a) the certificate was in force immediately before the commencement of this section and would, apart from subsection (2), end on or before 31 December 2012; or (b) the chief executive returns the certificate under section 124(2) after the commencement of this section and the certificate would, apart from subsection (2), end on or before 31 December 2012; or (c) the certificate is granted on or after the commencement of this section. ‘(2) Despite section 54, the certificate is for a term starting on the day it was granted and ending at the end of 31 December 2012. ‘377 Application for renewal of bonded asbestos removal certificate ‘(1) This section applies to an application for renewal of a bonded asbestos removal certificate if— (a) the application was made but not decided before the commencement of this section; or (b) the application is made on or after the commencement of this section. ‘(2) If the chief executive decides to grant the application, the renewed certificate is for a term starting on the day it is granted and ending at the end of 31 December 2012. ‘(3) Subsection (2) applies despite any provision of the Act or any other law. 2011 SL No. 55 Page 3

Workplace Health and Safety Amendment Regulation (No. 1) 2011 [s 5] ‘378 Particular certificates of authority of appointment of a workplace health and safety officer to end 31 December 2011 ‘(1) This section applies to a certificate of authority of appointment of a workplace health and safety officer if— (a) the certificate was in force immediately before the commencement of this section and would, apart from subsection (2), end on or before 31 December 2011; or (b) the chief executive returns the certificate under section 124(2) after the commencement of this section and the certificate would, apart from subsection (2), end on or before 31 December 2011; or (c) the certificate is granted on or after the commencement of this section. ‘(2) Despite section 57(4), the certificate is valid for the term starting on the day it was granted and ending at the end of 31 December 2011. ‘379 Application for renewal of certificate of authority of appointment of a workplace health and safety officer ‘(1) This section applies to an application for renewal of a certificate of authority of appointment of a workplace health and safety officer if— (a) the application was made but not decided before the commencement of this section; or (b) the application is made on or after the commencement of this section. ‘(2) If the chief executive decides to grant the application, the renewed certificate is for a term starting on the day it is granted and ending at the end of 31 December 2011. ‘(3) Subsection (2) applies despite any provision of the Act or any other law.’.
