WORKERS' liOMES ACTS AMENDMENT [ASSENTED TO 12TH OCTOBER, 1925.] Am OF 1925. B E it enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- lativD Asgembly of Queensland in Parliament assemHed, and by the authority of the same, as follows:- Short title 1. This Act may be cited as " The Workers' Homes a co n n d struction Acts Amendment Act of 1925," and shall be read as one -of Act. with *" The Workers' Homes Acts, 1919 to 1922," herein collectively referred to as the Principal Act. Amendments 2. The Principal Act is hereby amended as <>f Principal follows:- Act;. Amendment (i.) In section two, before the definition of "Fund" <>f s. 2. the following definition is inserted :- Ca.pital cost <>f a.lteration, enlargement, <or improve- .Dlent. " "Capital cost of alteration, enlargement, or improvement" includes the cost to the Minister of effecting the alteration, enlarge- ment, or improvement, and in addition an amount equal to simple interest at the rate of five pounds per centum per annum on such cost from a date to be fixed by the lYlinister to the date of the execution of the endorsement referred to in section 16A of this Act on the contract of ,qale of the home." (ii.) After section eight the following section is inserted :- Fencing_ "[8A.] Where land has been set apart or acquired for the purposes of this Act, the provisions of t" The Fencing Act of 1861" er of any Act amending or in substitution for that Act sh'111, save a,s herein mentioned, apply to the external boundaries of such land and to any boundaries of subdivisions thereof made by the Minister, and for that purpose the aforesaid land shall be deemed to be alienated land within the meaning of that Act: * 10 Geo. Provided that in substitution for the provisions of '*" The Fencing Act of 1861" relating to the notice to .adjoining owners the following provision shall apply:- The publication in the Gazette of a notice by the Minister calling upon the owners or occupiers of land, whether adj oining the external boundaries of land set apart or acquired for the purposes of this Act or adj oining any internal subdivisional boundaries of any such land, to assist in or contribute to the erection of ,dividing fences in equal proportions when required by the Minister so to do shall be and constitute a sufficient notice under and for the purposes of *" The Fencing Act of 1861."" (iii.) After section sixteen the following section is inserted :- " [16A.] Any alteration, enlargement, or improve- Improve- ment effected by the Minister of or to a home which is : ~ ~ : B, &e., the subject of a contract of sale upon the application of contract of the purchaser thereof (whether such contract was made r: I~ . entered "before or after the passing of "The Workers' Homes Acts Amendment Act of 1925 ~') shall not prejudicially affect such contract; but the capital cost of such alteration, -enlargement, or improvement, or such part thereof as the Minister deems' fit, shall be added to the unpaid purchase money of the home and become part thereof, .and the monthly rent of the home and appurtenant land shall be so increased as will permit of the liquidation ·of the increased purchase money together with interest ,as prescribed not later thlin the date of the expiration of the original term of the contract of sale, and the contract <of sale shall be deemed to be amended accordingly. The necessary amendments of the contract of sale shall be -endorsed upon the instrument, and when signed by the proper officer shall be deemed to be included in and shall become part of the contract of sale and binding on the parties." ,,. 25 Vie.
