[ASSENTED TO 17TH NOVEMBER, 1919.] B E it enacted by the Ring's Most Excellent Majesty, by and with the advice and consent of the Legis· lative Cquncil and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows :-. Short title. 1. This Act may be. cited as "The Workers' Homes Act of 1919." p In re te ta r- tion. 2. The Minister shall, for the purposes of this Act, be and act as the representative of the Crown, and as such shall have and may exercise all the powers, privileges, rights, and authorities of the Crown. Any action or other legal proceeding under or for the purposes of this ,Act may be brought or taken by or against the Minister in his official name. Minister may contract. Power to delegate. (2.) The Minister may enter into any contract with any person for doing anything which the Minister is authorised to do under this Act, or which is necessary or expedient for carrying out any of the purposes of this Act. (3.) The Minister may delegate to any State officer or other person the power on his behalf to execute any contract or other document or to do any Act which the Minister is authorised or required to execute or do by or' under this Act. Composition (4.) The Minister may, for such sum of money or ~~ rc~~~~~~:s other consideration a!:l he thinks fit, compound with any &0. ' person who has entered into any contract with the Minister, or by or against whom any 'Il,c.tion or other proceeding may be or has been brought against or by the Minister, for any cause whatsoever. Authentica- (5.) Subject to this Act, every appointment and tdioocnuomfents. every order, notice, certificate, or other document relating to the execution of this Act or the business of the Minister thereunder shall be sufficiently authenticated if signed by the Under Secretary of his Department or any person authorised generally or specially by the Minister to sign the same. There is hereby created a Fund to be called the" Workers' Homes Fund." Such Fund shall be administered. by the Minister. (2.) (2.) The price or compensation p~ yable in respect of Payment of all land compulsorily acquired by the Minister under this price. I 7. Subject to this Act, the Governor in Council Debentures. may from time to time issue such del;>entures as may be necessary for any of the purposes of this Act not exceed- ing in the aggregate the sum of fiv~ hundred thousand , pounds. . All such debentures shall be secured upon the Consoli- dated Revenue Fund, and shall have such currency not exceeding twenty years, and shall bear interest at such rate, and shall be subject to such conditions as shall be • fixed by the Governor in Council. The Minister may cause a plan of subdivision to ~ : : dr: gd be made of any Crown land set apart for the purposes of thereon. this Act or of any land acquired, whether by agreement or compulsorily, for the purpos~ s of this Act, showing the proposed roads and reserves and the land set apart as sites for homes and other buildings or for religious, charitable, or local purposes. The Minister may cause any work to be done on such land for the purpose of rendering it fit for the use to which it may be put under this Act. He may dedicate reserves for public recreation or for other public purposes, and fence, plant, and improve such reserves. He may erect homes on allotments set apart as sites for the same. Contracts of sale. 9. (l.) The Minister, upon being satisfied that ~ a proposed purchaser of a home- (a) Is a worker; and (b) Bona fide intends to use the home solely as a home for himself or herself and his or her dependants, may enter into a contract for the sale to such person of such home. Such contract is herein referred to as a " contract of sale." (2.) The only persons eligible and qualified to enter into a contract with the Minister for the purchase of a home shall be workers. (3.) Where more persons than one apply to become purchasers of the same home preference may be given to the applicant who has the lesser income or the more numerous fa·mily, provided he is of good character and the Minister is satisfied as to his ability to perform the contract of sale. Subject to the provision last aforesaid, where several applications to purchase the same home are made at the same time preference as between those applications shall be determined by lot in the prescribed manner. v. * 5 Geo. "Whenever any question arises as to- (a) "Whether the facts exist necessar¥ to constitute any person a worker within the meaning of this Act; or (b) The capital cost of a home, the decision thereon of the Minister or any person deputed by him in that behalf shall be final and conclusive and shall not be questioned in any proceedings whatsoever. (5.) If a purchaser of a home under a contract of sale becomes the owner of any other dwelling-house in Queensland at any time before such contract of sale has been fully performed, the unpaid balance of the purchase moneys secured- by the contract of sale with accrued interest (if any) shall forthwith be and become due and payable to the Minister without 1ile necessity for any demand therefor : Provided that the provisions of this subsection shall not apply to any such purchaser who becomes the owner of any other dwelling-house as the trustee of any insol- vent estate, or of an insane person, or of a marriage settlement, or as the. devisee, legatee, ex.ecutor or administrator, or one of the next-of-kin of a deceased ' person, until the expiration of twelve months after he has become such owner, and thereafter, if he has ndt disposed of such other dwelling-house, the provisions of this sub- section shall apply. - 10 The purchasing price of a home shall be fixed Limit of by the Minister but shal1 not in any case exceed the p~ chasing capital cost to the Minister of the home. prlCe. 11.· A purchaser of a home· shall at the time of the Deposit. execution of the contract of sale pay to the Minister a deposit on the purchasing price equal to five pounds per centum of such price. Such deposit shall be received and credited by the Minister to the purchaser as part payment of the purchasing price. . 12. Every contract of sale shall be in writing in the Form of form prescribed, and shall be signed by the purchaser COftl'Mt o~ and by or on behalf of the Minister. sa e. It shall be subject in all respects to the provisions of this Act, which shall be deemed to be incorporated in and form part thereof, and shall contain such terms, stipulations, covenants, and conditions as may be pre- scribed or as may be determined by the Minister.

Forthwith upon the" payment of a deposit ~ ~ ! ~ ~ ~ ~ ; r hereby prescribed to be paid upon the execution of the sale. contract of sale the purchaser shall be entitled to- (a) Enter upon and take possession of the home and the appurtenant land; (b) The grant of a perpetual lease of the appur- tenant land; and shall also be subject to all the duties and obligations which by this Act and the contract of sale are imposed upon a purchaser of a home. ", Perpetual Town and Suburban Leases. 14. (1.) The Minister, with the approval of the Governor in Council, may from time to time, by notifica- tion in the Gazette, cause any Crown land or land acquired for the purposes of-'this Act to be open for lease as Perpetual Town Leases or :Perpetual Suburban Leases for the purposes of homes under this Act or for the purposes of erecting buildings thereon for business or public use: Pro"vided that such leases for thEil purposes of homes shall not be offered at auction, and the only persons authorise<t or permitted to apply for or hold such leases shall be purchasers of homes erected on such lands and 4heir tran~ ferees respectively. " (2.) Such notification shall state the capital value of the land exclusive of the value of any improvements thereon. (3.) Where land is subdivided by the Minister for the purposes of this Act, the Minister may determine the capital value of each subdivision, having regard to its size and to its position' in the subdivisional plan; but the aggregate capital value of all the subdivisions as so determined shall be equal to the total cost or value of the land, including any land comprised in such plan which has been reserved or set apart for roads or reserves or for religious, charitable, or local purposes, and also any . sums expended or to be expended by the Minister in development work or in forming roads. Oondition (4.) As between the Minister and the purchaser = ~ ~ ~ : e~ ~ t under a contract of sale, the following condition shall be l6lld. imposed until the contract of sale is fully performed, namely:-- The aI1purtenant land shall not be transferred, subdivided, or let, or abandoned by such purchaser without the consent of the Minister.
LABOUR. 9171 1919. Workers' Homes Act. Every agreement for transfer or letting contrary to this subsection shall be void and of no effect. (5.) Any perpetual lease under this section may contain such special covenants, conditions, stipulations, and provisions as may be deemed necessary or requisite for carrying into effect the provisions of this Act. (6.) The rents in respect of all perpetual leases under this section shaH be payable weekly to tle Minister, and all such rents from time to time received by him shall be paid into the Fund. (7.) Except as herein otherwise provided, every such lease shall be and be deemedto be a Perpetual Town Lease or .Perpetual Suburban Lease, as the case may . require, under the LandAct; and the provisions of section one hundred and twenty-one of that Act (save as herein modified), and the provisions of that Act in the said section referred to, shall apply to every such lease so far as the same are applicable: Provided, however, that wherever reference is made in any of the said pro- visions to the Minister the reference shall, for the purposes of leases under this Act, be deemed to be to the Minister charged with the administration of this Act instead of to the Secretary for Public Lands. 15. The amount of the weekly rent of the home Rent, how and the appurtenant land payable by the purchaser to computed. the Minister under a contract of sale shall be ascertained as follows :- A sum equal in amount to onefifty-secondthpart of the interest calculated at the rate of five pounds per centum per annum on the outstanding balance at the beginning of each quarter of the year of the capital cost of the home shall be payable; to this shall be added and be payable--- . (a) Such instalment of the unpaid purchase money· to be fixed by the Minister as will permit the whole of such, unpaid purchase money to be liquidated and paid within a period to be determined by the Minister, but not exceed- .

No. 7, . ing twenty years, provided that in special cases the Minister may, notwithstanding such limitation, fix such period longer than twenty years for the payment of the. unpaid purchase money as he deems expedient; also (b) Such sum to be declared in the contract of sale as the Minister considers sufficient to provide for expenditure on insurance, painting, and repairs of the home as and when such 'expenditure may be required and also. for recoupment to the Minister of a proportionate amount of the general expenses incurred in the administration of this Act; also (c) The weekly rent in respect of the perpetual lease of the appurtenant land. The aggregate amount so arrived at shall be deemed to be the weekly rent of the home and the appurtenant land and shall be payable weekly in advance or other- wise as the contract of sale may provide. The unpaid balance of the purchase moneys secured by a contract of sale may at the option of the purchaser be paid at any time sooner or in larger instalments than the contract provides. Pu~ ohaser . 17. The purchaser shall, unless exempted as herein- ~ : ' DBure hIS after provided, effect and until the contract of sale is fully performed keep in operation an insurance with the State Government Insurance Office upon his life in the form prescribed in an amount sufficient to pay to\ the Minister, in the event of the death of the purchaser, the full amount of the unpaid purchase money and other moneys secured by the contract of sale and this Act. Such policy of life insurance shall be deemed to -be incorporated with the contract of sale and form part thereof, and the policy f?hall be assigned to and held by the Minister: Provided that the Minister in his discre~ tion may accept in lieu of the policy of insurance aforesaid any existing policy of life insurance which in the Minister's opinion is a sufficient security: Provided that the Minister in his discretion may exempt any purchaser from compliance with this section upon being satisfied that- (a) The purchaser is unable to pass any medical test prescribed as a condition for life insur- ance; or l

(b) The payment of life insurance premiums would by reason of the age of the purchaser be .a hards~ ip upon him. 18 The purchaser shall, until the contract of .sale Duties of has been fully performed- purcha.wr. (a) Keep the appurtenant land free from all noxious weeds and plants, particularly prickly- pear, china apple, noogoora burr, and bathurst burr; and . (b) Notwithstanding any other Act to the contrary, pay all rates and taxes, and' perform all the lawful requisitions of any local or other authority with respect to the home or the appurtenant land; and «(i) Perform the conditions of the perpetual lease of the appurtenant land and observe the provisions of any Act under which the land is held. 19 Where the consent of the Minister is sought to Transfer of the transfer .of any home or the I perpetual lease of the ~ ~ x: : ~ &r appurtenant land, the Minister may require as a condition to his consent that the 1;ransferee shall enter into and execute, in favour of the Minister, such contract bond, covenants, and other instruments and securities as will effectually secure the payment by the transferee of all sums of money with the prescribed interest for payment of which the transferor is liable under the con- tract of sale, and upon the entering into and execution of the same the transferee shall be equally bound thereby as if the contract of sale had been made with him in the first instance. 20. In any case where the Minister is satisfied that Abandoned any home in respect of which a contract of sale is not home, fully performed has been abandoned by the purchaser and is without a lawful occupant, the Minister may in his discretion either- (a) Cancel the contract of sale, in which case the home and appurtenant land shall thereafter be subject to be dealt with and disposed of under this Act as if no such contract of sale had ever been entered into; but,nevertheJess, the Minister shall have all the rights and remedies provided by this Act against the pU,rchaser as for a breach of contract; or

No. 7, (b) Enter upon and take possession of such home and the appurtenant land and retain possession of the same, and let the same, and apply the rents and profits in payment of the costs and expenses from time to time incurred in con- nection with such home and land, and of the moneys, if any, due under this Act, and hold the balance, if any, in trust for the purchaser. Money due 21. In addition to any other remedy provided by :; ! ~ ~ s: r t.his Act for the recovery of any sum of money payable Crown. under any provision of this Act to the Minister by a purchaser of a home or tenant of the Minister, it is hereby declared that every such sum shall be and remain until payment a debt due by the purchaser or tenant to the Crown, and. shall be recoverable by the Minister accordingly. Remedies ~ ! ~ ~ P. 22. (1.) If default is made by the purchaser in the payment of any sum payable by him to the Minister under a contract of sale, or if the purchaser commits any breach of any covenant or eondition t9 be observed by him under any contract of sale or under this Act, the whole of the purchase money then remaining unpaid shall forthwith become due and payable, and shall be recover- able, with interest at the prescribed rate, by the Minister accordingly. (2.) If default is made by the purchaser in the pay- ment of any sum of money payable by him to the Minister, . then, without prejudice to.any other remedy, and although no legal demand has been made for the payment thereof, the Minister may enter upon and take possession (for that. purpose using such forp.e as may be necessary to eject any occupant) of the home and appurtenant land, 'and may determine the t,enaney of th( ~ home, and, not-with- stand.jng anythmg contamen m the Land Act, may cancel and determine the perpetual lease of the appurtenant \ land. And if after considering any repre- sentations which the purchaser may make the Minister is satisfied that the information aforesaid is true, and that it is right and proper that the contract of sale and perpetual lease of the appurtenant land should be cancelled, the following consequences may ensue:- (a) The Minister may cancel the contract of sale, wh~ reupon although no legal demand has been made he may enter upqn and take possession (for that purpose using such force as may be necessary to eject any occupant) of the home and appurtenant land and determine the tenancy of the home; (b) Notwithstanding anything contained in the Land Act the Minister may cancel and deter- mine the perpetual lease of the appurtenant land; (c) The Minister may in his discretion repay to the purchaser the whole or such propordon as ·he. thinks fit of the purchase money of the home which has been paid by the purchaser under this Act; (d) The home and appurtenant land shall there- after be subject to be'dealt with and disposed of under this Act as if no such contract of sale had ever been entered into. 24 No judgment, order, or decree of any court Judgment of of law shall in any way affect the security or remedies e~ ur: not to of the Minister under a contract of sale; and until the : o~ ~ raet of contract of sale has been fully performed no process of sale. la.w shall interfere with such security or remedies. 25. Regulations. 27. (1.) The Governor in Councillllay from time to time make all such regulations as he deems necessary or convenient for the administration of the business of the Minister under this Act and otherwise giving full effect to its provisions. . (2.) Without limiting the generality of the foregoing provision, regulations may be made for all or any of the following purposes:- (a) Prescribing the fees payable to the Minister in respect of applications to purchase homes or any other matter arising under this Act; (b) Prescribing the form of contracts, leases~ notices, certificates, and other documents under this Act; (c) Provide for the formation of tenants' com- mittees and prescribe their powers and duties. (3.) All such regulations, when published in the Gazette, shall be judicially noticed and havethe same effect as if they were enacted in this Act. Such regulation and any amendment thereof shall be laid before both Houses of Parliament within fourteen sitting days after such publication if Parliament is in session, and if not in session within fourteen sitting days: after the commencement of the next ensuing session of Parliament. (4.) If either House of Parliament passes a resolution disallowing any such regulation, of ,which resolution notice has "been given at any time within fourteen sitting, days of such House after such regulation or amendment thereof has been laid before it, such regulation or amendm€Znt thereof shall thereupon cease to have effect, but without prejudice to the validity of anything done in the meantime. . (5.) For the purpose of this A ct, the term "sitting days" shall mean days on which the House actually sits. for the despatch of business:

[ASSENTED TO 9TH MARCH, 1920.] B E it enac.t;ed by the King's Most Excellent Majesty, by and with the advice and consent of the Legis- ~ tive Council and Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. This Act may be cited as "The Land Act Amend- Short title ment Act of 1920," and s~ all be read as one with ,*"The':!truction Land Act of 1910," herem referred to as the PrmcipalofAct. Act. / 2. (1.) In section forty-three of the Principal Act, Amendm3nt the following words are repealed:~ . of B.43. . "Provided that, with respect to aU pastoral ho1dings ~ t>« 1t. .si:3' mentioned in the Second Schedule, except when other- . wise expressly stated in the said Schedule, the annual rent for each period after the .first shall not exceed the annual rent payabJe for the next preceding period by more than one-half of the annual rent payable for such precedingp~ riod. * 1 Geo. v.
