AN ACT to amend the Workers' Compensation and

Assistance Act 1981-1983.

[Assented to 22 December 1983.]

BE it enacted by the Queen's Most ExcellentMajesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

1. (1) This Act may be cited as the Workers' Eicolvkttii,„,.

(3) The principal Act as amended by this Act may be cited as the Workers' Compensation and Assistance Act 1981-1983.

Section 5

amended.	2. Section 5 of the principal Act is amended in subsection (1) by deleting the definition of "Supplementary Board".
Section 106

amended. 3. Section 106 of the principal Act is amended in

subsection (3)-

(a)	by deleting "and any Supplementary Board" in paragraph (a); and
(b)	by deleting ", the Board, and any Supple- mentary Board" in paragraph (e) and substituting the following-

" and the Board ".

Section 112

amended. 4. Section 112 of the principal Act is amended in

subsection (14)-

(a) by inserting after "duty" the following-

" or declines to deal with any matter ";

and

(b) by inserting after "so absent" the follow- ing

" or so declines ".

Section 113

repealed.	5 Section 113 of the principal Act is repealed.
Section 140A
repealed and	6. Section 140A of the principal Act is repealed
substituted.

and the following section is substituted

CI 140A. In this Division, unless the context

otherwise requires, "Board" includes a Supple- mentary Workers' Compensation Board constituted under this Act before the coming into operation of the Workers' Compensation and Assistance Amendment Act (No. 2) 1983. ".

7.    Section 185 of the principal Act is amended by gleetV.85

repealing subsection (1).

8.    Schedule 6 to the principal Act is amended in 2=1.6

item 2 by deleting "(the Workers' Compensation Board or the Supplementary Workers' Compensation Board, as the case may be)" in paragraphs (a) and

(b) and in each case substituting the following- " the Workers' Compensation Board ".

9.    The persons who, immediately before the Transitional.

coming into operation of this Act, held office as nominee members of the Supplementary Workers' Compensation Board may be employed by the Minister for terms expiring when their respective terms of office as such nominee members would, but for this Act, have expired subject to such terms and conditions as the Minister thinks fit, and for the purposes of section 106 (3) (a) of the principal Act those persons shall, while so employed, be taken to be staff of the Commission.
