Name of regulation
This regulation is the Workers Compensation Amendment Regulation 2005 (No 1).
Commencement
This regulation commences on the day after its notification day.
NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
Legislation amended
This regulation amends the Workers Compensation Regulation 2002.
Section 68 (1) (d)
substitute
(d)evidence that the insurer has adequate reinsurance, or other arrangements in place, to cover the insurer’s future liability under the Act;
New section 68A
insert
68AApplications made but not decided before commencement of s 68 amendment
(1)This section applies to an application for approval of an insurer made, but not decided, before the commencement of the Workers Compensation Amendment Regulation 2005 (No 1) (the amendment regulation).
(2)The application is not affected only because it does not comply with section 68 as amended by the amendment regulation.
(3)In considering the application, the Minister need not take into consideration a matter included, or not included, in the application that would not be required to be included in the application after the amendment of section 68 by the amendment regulation.
(4)This section expires 1 month after the day it commences.
(5)Subsections (1) to (3) are laws to which the Legislation Act, section 88 (Repeal does not end effect of transitional laws etc) applies.
