(Delegation) Regulation 2009

His Excellency the Lieutenant-Governor, with the advice of the Executive Council, has made the following Regulation under the Workplace Injury Management and Workers Compensation Act 1998.

Explanatory note
The object of this Regulation is to amend the Workers Compensation Regulation 2003 to enable the WorkCover Authority to delegate functions relating to scheme agents to a person who is a part-time member of the Board of Directors of the Authority.

This Regulation is made under the Workplace Injury Management and Workers Compensation Act 1998, including sections 21 (3) and 248 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Workers Compensation Amendment (Delegation)
Regulation 2009.

2      Commencement

This Regulation commences on the day on which it is published on the
NSW legislation website.

3 Amendment of Workers Compensation Regulation 2003

Clause 197A

Insert after clause 197:

197A Delegation of Authority’s functions: sec 21 of 1998 Act

The class of persons consisting of part-time members of the Board of Directors is prescribed for the purposes of the definition of authorised person in section 21 (3) of the 1998 Act, but only in respect of the delegation of any functions of the Authority relating to scheme agents (including the appointment of scheme agents).
