AN ACT to amend section twenty-five of the

Workers' Compensation Act, 1912-1978.

[Assented to 11th December, 1979.]

BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:-

1. (1) This Act may be cited as the Workers' 2coirt title

(2) In this Act, the Workers' Compensation Act, approved

Section 25

amended.

2. Section 25 of the principal Act is amended

(a)

by redesignating subsection (13a) as (13b) and inserting after subsection (13) the following subsection

(13a) Notwithstanding subsection (13) of this section, if any proceedings have been heard in part by the Board but not completed before the retirement of the Chairman or the retirement or expiry of office of a nominee member of the Board, the Governor may authorize the Chair- man or member to continue to perform the functions of Chairman or member of the Board for a period not exceeding six months for the purpose only of completing those proceedings and in any such event the Chairman or member shall be entitled to such remuneration or allow- ances as the Governor shall determine. ; and

(b)

by inserting after subsection (17) the following subsection

(17a) Proceedings may be continued, notwithstanding any change in the membership of the Board, as if the change had not occurred; and in particular evidence taken by the Board need not be taken again on account of the change. .
