AN ACT to amend the Workers' Compensation
Act, 1912-1960.
[Assented to 28th November, 1961.]
BE it enacted by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Council and the Legislative Assembly of Western Australia, in this present Parliament assembled, and by the authority of the same, as follows:—

2. Section eight of the principal Act is ?..glended.
amended—
| (a) | by repealing subsection (la) and re- enacting it with amendments as follows |
(la) Where a worker is disabled from earning full wages by reason of suffering from, or his death is caused by, silicosis, pneumoconiosis or miner's phthisis and the disease is, or was, due to the nature of any employment in which the worker was employed at any time, previous to the date of the disablement and it is shown to the satisfaction of the Board that, since he was last employed in the State in any employment of that nature, the worker
| (a) | has not been, absent from the State for a period of, or periods aggregating, more than six months; or |
| (b) | having been absent from the State for a period of, or periods aggregating, more than six months, has not during that period or those periods been employed in any employment of that nature, |
then he is or, in the case of his death, his dependants are, subject to this section, entitled to compensation in accordance with this Act, as if the disease were a personal injury by accident, within the meaning of section seven of this Act, suffered by the worker at the place of his employment. ; and
| (b) | by adding, immediately after subsection (la), the following subsection-- |
(lb) Subsection (la) of this section shall be deemed to have come into operation on the same day as that on which the Workers' Compensation Act Amendment Act, 1960, came into operation, namely, the twelfth day of December, One thousand nine hundred and sixty.
