WORKERS COMPENSATION ACT 1989—REGULATION
(Relating to the rates for treatment of injured workers at private hospitals)

HIS Excellency the Governor, with the advice of the Executive Council,
and in pursuance of the Workers Compensation Act 1987, has been
pleased to make the Regulation set forth hereunder.

The Workers Compensation (General) Regulation 1987 is amended:
| (a) | by inserting in clause 10A in alphabetical order, the following definition: |
“procedure benefit band” means a category of treatment requiring the use of an operating theatre and listed in the
Medibank Private Procedure Benefit Bandings, published by
Medicare Private and as in force on 10 May 1991;
| (b) | by omitting the Table to clause 10B (a) and by inserting instead the following Table: |

EXPLANATORY NOTE
Section 62 of the Workers Compensation Act 1987 provides that the amount for which an employer is liable in respect of hospital treatment for an injured worker is
the cost to the hospital of the treatment, calculated in the manner prescribed in the
Workers Compensation (General) Regulation 1987.
The object of this Regulation is:
• to adopt a different system of categorisation of treatments requiring the use
of an operating theatre based on the Medibank Private Procedure Benefit
Bandings; and
• to increase the amounts payable by employers for treatment of workers at
private hospitals.
