WORKERS COMPENSATION ACT 1987—REGULATION

(Relating to conditions of insurance policies)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Workers Compensation Act 1987, has been pleased to make the Regulation set forth hereunder.

Commencement

1. This Regulation commences on 30 June 1994

Amendments

2. The Workers Compensation (General) Regulation 1987 is amended:

(a)

by omitting condition 1 of Form 7 in Schedule 1 and by inserting instead the following condition:

Notices

1.  Notices required to be given under this Policy are to be delivered, posted or transmitted electronically:

(a)

if the Insurer is the receiver-to the office from which this Policy or the last renewal notice was issued; or

(b)

if the Employer is the receiver-to the address of the Employer last known to the Insurer.

(b)

by inserting after condition 9 of Form 7 in Schedule 1 the following condition:

Renewal of Policy

9A. This Policy is renewed (without application) on the expiration of a period of insurance to which it applies unless:

(a)

the Employer has given written notice to the Insurer before that time that renewal is not required; or

(b)

the Insurer has, with the consent of the WorkCover Authority under section 157 of the Act, decided to refuse the renewal and has, at least 14 days before that time, given the Employer written notice of that refusal.

The period of each such renewal is 12 months.

(c)

by omitting from condition 10 of Form 7 in Schedule 1 the words “withinmentioned address” and by inserting instead the words “address of the Employer last known to the Insurer”.

EXPLANATORY NOTE

The objects of this Regulation are:

to extend the condition relating to the sending of notices under the prescribed insurance policy so that it refers to the relevant employer’s address, and to make a minor amendment concerning the notice of cancellation of a policy

to insert a new condition in the prescribed insurance policy to provide for the automatic renewal of policies of insurance (issued or renewed from 30 June 1994).

This Regulation is made under sections 280 (the general regulation-making power)
and 159 (provisions of policies of insurance) of the Workers Compensation Act 1987.
