Her Excellency the Governor, with the advice of the Executive Council, has made the following Regulation under the Workers Compensation Act 1987 and the Workplace Injury Management and Workers Compensation Act 1998.

Explanatory note

Section 79A of the Workplace Injury Management and Workers Compensation Act 1998 requires parties to a dispute that is referred to conciliation to exchange information relevant to the dispute, and to give that information to the Principal Conciliator.

The Workers Compensation Legislation Amendment Act 2001 contains new procedures for workers compensation claims that do not provide for conciliation of disputes. The provisions setting out those new procedures have not yet been proclaimed to commence.

The object of this Regulation is to disapply section 79A for disputes that have not yet been referred to conciliation, in order to streamline conciliation procedures in preparation for the cessation of conciliation when new procedures for claims commence.

Insert after clause 51AA:

51AB Exchange of information before conciliation—transitional

provision

Section 79A of the 1998 Act does not apply to any dispute, whether arising before or after the commencement of this clause, that, immediately before the commencement of this clause, had not been referred for conciliation.
