1  Name

This instrument is the Work Health and Safety (Warlike Service—Operation Okra) Declaration 2017.

2  Commencement

(1)  Each provision of this instrument specified in column 1 of the table commences, or is taken to have commenced, in accordance with column 2 of the table. Any other statement in column 2 has effect according to its terms.

3  Authority

This instrument is made under subsection 12D(2) of the Work Health and Safety Act 2011.

4  Definitions

In this instrument:

Act means the Work Health and Safety Act 2011.

Operation Okra means the warlike operation in Iraq and Syria.

warlike operation means an operation involving members of the Defence Force outside Australia:

(a)  that is likely to result in fatalities; and

(b)  for which those members are authorised to use lethal force for specific military objectives.

Example:    Combat operations against an armed adversary or operations undertaken as part of a declared war.

5  Provisions of Act declared not to apply to specified activity

For the purposes of subsection 12D(2) of the Act, paragraphs 28(a) and (b) of the Act do not apply in relation to the warlike operation named Operation Okra.

6  Repeal of this instrument

This instrument is repealed at the end of the day that is 3 years after the day this instrument commences.
