1   Short title

This regulation may be cited as the Work Health and Safety (Plant Registration) Amendment Regulation 2020.

2   Regulation amended

This regulation amends the Work Health and Safety Regulation 2011.

3   Amendment of s 2 (Commencement)

Section 2(2C)—
omit.

4   Replacement of s 272 (Duration of registration)

Section 272—
omit, insert—

272   Duration of registration

A registration of an item of plant takes effect on the day registration is granted and expires on 31 January first occurring after the day registration is granted.

5   Omission of s 272A (Duration of registration on commencement)

Section 272A—
omit.

6   Amendment of s 279 (Decision on application)

Section 279(2)(d)—
omit.

7   Replacement of s 279A (Duration of renewal on commencement)

Section 279A—
omit, insert—

279A    Duration of renewal

A renewal of a registration of an item of plant is valid from the day the registration is renewed until 31 January in the following year.

8   Insertion of new s 701B

After section 701A—
insert—

701B    Fee waiver for registration of particular items of plant

(1)This section applies in relation to an application for registration or renewal of the registration of an item of plant if—
(a)the item of plant is an amusement device mentioned in schedule 5, part 2, section 3, item 3.6; and
(b)the registration or renewal of the registration is for a period ending on 31 January 2021.
(2)The relevant fee for the application is waived.
(3)If a person has paid or pays the relevant fee to the regulator, the regulator must refund to the person an amount equal to the amount of the relevant fee paid by the person.

9   Insertion of new pt 13.8

Chapter 13—
insert—

Part 13.8    Transitional provision for Work Health and Safety (Plant Registration) Amendment Regulation 2020

795   Application of s 701B

(1)Section 701B applies in relation to an application for registration or renewal of the registration of an item of plant, whether the application was made before or after the commencement.
(2)However, if an item of plant was registered before the commencement, section 701B does not apply in relation to an application for the registration or the renewal of the registration of the item of plant if the registration was cancelled before the commencement.
