  1. Name of regulation

    This regulation is the Work Health and Safety Amendment Regulation 2013 (No 1).

  2. Commencement

    This regulation commences on 1 January 2014.

    NoteThe naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

  3. Legislation amended

    This regulation amends the Work Health and Safety Regulation 2011.

  4. New part 20.4B

Part 20.4BInvestigations

816BInvestigations under Work Safety Act 2008

(1)This section applies to an investigation under the Work Safety Act 2008 of an event, accident or other incident that happened before the commencement day.

(2)An inspector under the Work Health and Safety Act 2011 may exercise any function of an inspector under the Work Safety Act 2008 in relation to the investigation.

816CFunctions under director-general’s delegations

(1)This section applies if—

(a)the director-general delegated a function of the director‑general (the delegated function) under the Work Safety Act 2008 to a person; and

(b)the delegation was in force immediately before the commencement day.

(2)The person may exercise the delegated function in relation to an investigation under the Work Safety Act 2008 of an event, accident or other incident that happened before the commencement day.
