His Excellency the Governor, with the advice of the Executive Council, has made the following

Regulation under the Work Health and Safety Act 2011.

Explanatory note
Section 271 of the Work Health and Safety Act 2011 prevents disclosure of information obtained by a person exercising a power or function under that Act. However, section 271 (3) provides for certain exemptions to that prohibition, including where the disclosure of the information is necessary for the administration or enforcement of another Act prescribed by the regulations. The object of this Regulation is to prescribe certain workers compensation Acts for the purposes of section 271 (3).

This Regulation is made under the Work Health and Safety Act 2011, including sections 271 (3) (c) (ii) and 276 (the general regulation-making power).

1      Name of Regulation

This Regulation is the Work Health and Safety Amendment (Disclosure of
Information) Regulation 2015.

2      Commencement

This Regulation commences on the day on which it is published on the NSW legislation website.

3 Amendment of Work Health and Safety Regulation 2011

Clause 702 Confidentiality of information—exception relating to administration or enforcement of other laws

Insert after clause 702 (q):

(r) Workers Compensation Act 1987,
(s) Workers Compensation (Bush Fire, Emergency and Rescue Services) Act 1987,
(t) Workers Compensation (Dust Diseases) Act 1942,
(u) Workplace Injury Management and Workers Compensation Act 1998.
