Clause 1 Woollahra Local Environmental Plan 1995 (Amendment No 48)

Woollahra Local Environmental Plan 1995 (Amendment

No 48)

under the

Environmental Planning and Assessment Act 1979

1      Name of plan

This plan is Woollahra Local Environmental Plan 1995

(Amendment No 48).

2      Aims of plan

The aims of this plan are:

(a)	to alter the boundaries of the Woollahra Heritage Conservation Area to include additional properties which contribute to the significance of the Area and to reflect recent local government boundary changes, and
(b)	to introduce certain savings and transitional provisions.

3      Land to which plan applies

This plan applies to land edged heavy black on the map marked “Woollahra Local Environmental Plan 1995 (Amendment No 48)— Heritage Conservation Map” deposited in the office of Woollahra Council.

4 Amendment of Woollahra Local Environmental Plan 1995

Woollahra Local Environmental Plan 1995 is amended as set out in

Schedule 1.

(Clause 4)

[1]      Clause 37 Savings and transitional provisions

Insert in appropriate order:

(1B) A development application lodged with the Council, but not finally determined, before the commencement of Woollahra Local Environmental Plan 1995 (Amendment No 48) is to be determined as if that plan had been exhibited but had not been made.

[2]      Clause 37 (2C)

Insert in appropriate order:

(2C) An application to modify a consent under section 96 of the Act that was lodged but not finally determined before the commencement of Woollahra Local Environmental Plan 1995 (Amendment No 48) is to be determined as if that plan had been exhibited but had not been made.

[3]      Clause 37 (6)

Insert in appropriate order:

(6) An application to review a determination under section 82A of the Act that was lodged but not finally determined before the commencement of Woollahra Local Environmental Plan 1995 (Amendment No 48) is to be determined as if that plan had been exhibited but had not been made.
