Marketing Regulations2 (Amendment)
I,
THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice
of the Federal Executive Council, hereby make the following Regulations under
the Wool Marketing Act 1987.

Principal Regulations
1. In these Regulations, “Principal
Regulations” means the Wool Marketing Regulations.
Defunct companies and dissolved
partnerships
2. Regulation 6 of the
Principal Regulations is amended by omitting “or, with the approval of the
Corporation, by a registered person”.
Amount of Refund
3. Regulation 9 of the
Principal Regulations is amended by omitting from subregulations (4) and (5) “$10”
and substituting “$25”.
Refunds in respect of participating
wool to be paid by Corporation
4. Regulation 10 of the
Principal Regulations is amended:
(a)
by omitting from subregulation (1) “registered person on behalf of the
Corporation, or by the Corporation, in accordance with this regulation” and
substituting “the Corporation”;
(b)
by omitting subregulations (2) to (10) (inclusive).
Returns by registered persons
5. Regulation 11 of the
Principal Regulations is amended:
(a)
by omitting from subregulation (3) “3 months” and substituting “2 months”;
(b)
by omitting from that subregulation “authorize the registered person to”;
(c)
by omitting from that subregulation all the words after “payable” and
substituting “under regulation 10”;
Repeal of regulation 12 and saving
6. (1) Regulation 12 of the Principal Regulations is repealed.
(2) Subregulation 12 (4) of
the Principal Regulations as in force immediately before the commencement of
this regulation continues to apply in respect of payments authorised by the
Corporation before the commencement of this regulation to be made by a
registered person in respect of participating wool as if the amendments of the
Principal Regulations made by these Regulations had not been made.
Claims made upon the Corporation
7. Regulation 13 of the
Principal Regulations is amended:
(a)
by omitting from subregulation (1) “a registered person or”;
(b)
by omitting subregulation (2).
Manner of payment of refund
8. Regulation 14 of the
Principal Regulations is amended by omitting from subregulation (2) “or a
registered person” and “or the registered person”.
Repeal of regulations 15 and 16
9. Regulations 15 and 16
of the Principal Regulations are repealed.
Person receiving payment to which
he or she is not entitled
10. Regulation 17 of the
Principal Regulations is amended by omitting subregulation (2).
Payment of costs of registered
persons
11. Regulation 20 of the
Principal Regulations is amended by omitting from subregulation (1) all the
words after “costs incurred by them” and substituting “under this Part”.
Persons paying wool tax to furnish
details to Corporation in relation to each financial year
12. Regulation 21 of the
Principal Regulations is amended:
(a)
by omitting from paragraph (2) (a) “the name and” and substituting “the
surname, initials of the given names (or, in the case of a body corporate or
partnership—its full trading name) and the full”;
(b)
by omitting paragraph (2) (c) and substituting the following paragraph:
“(c)
whether that person was the producer of the wool or was reselling it as a
private dealer or agent;”.
Repeal of regulation 22 and saving
13. (1) Regulation 22 of the Principal Regulations is repealed.
(2) Regulation 22 of the
Principal Regulations as in force immediately before the commencement of this
regulation continues to apply in respect of moneys provided before the
commencement of this regulation to a registered person by the Corporation and
in respect of the performance of the functions of a registered person in
effecting payments in respect of participating wool on behalf of the
Corporation.
Proposed sampling site or
laboratory—inspection on behalf of the Secretary
14. Regulation 31 of the
Principal Regulations is amended by omitting from paragraph (b) “cause” and
substituting “within a reasonable time after so declining to deal further with
the application, cause”.
