| TREVOR DANIEL O'NEIL | Respondent |
| BRISBANE ..DATE 10/08/2007 |
DISTRICT COURT
APPELLATE JURISDICTION
JUDGE McGILL SC
No D1960 of 2006
ORDER the 5th of July 2006. There was nothing done before a Registrar's reference was brought before the Court on the 6th of November 2006 when another Judge directed that the appellant's outline of argument be filed and served by Friday, 8 December 2006. That was not done and the appellant has not taken any other steps to prosecute the appeal. A notice of the application was sent to the appellant's address for service and to Legal Aid more than 10 days before the hearing of this appeal.
In the circumstances there has been a failure to prosecute the appeal properly and a failure to comply with a direction of the Court and it is appropriate therefore that I act under section 229 and under that section I strike out the appeal.
