old Public School appi‘opviat('d for National School purposes pursuant to the Colonial Secretary’s letter dated tlic second day of January, in the year one thousand eight hundred and forty-nine, has ceased to be of any use as a school site for the purposes of the “ Public Instruction Act of 18S0”; And whereas doubts exist whether the said site reverted to the Crown pursuant to tlie provisions of the first section of tin? last cited Act, in consequence wlicreof the said site, altliough sub­ divided into allotments for sale by public auction, has not been sold; A?id Avhercas the Municipal Council of the Eorough of AVollon- gong, alter various unsucccssfid negotiations for the acquisition of the whole or a portion ol tlie said site, finally, on the eleventh of Decem­ ber, one tlionsand (dght hundred and eighty-five, obtained from tlie Government a pronusc that lots one to seven of the subdivided land should be sold to the said Council for a nominal consideration of five pounds, to be paid to the Government, which said consideration was afterwards jiaid by the said Council, who thereupon entered into possession of the said lots, and erected buildings thereon; And Avhereas tlie said lots have never been legally transferred, and cannot bo so transfei'red to tlu; said Council without the sanction ol tin; Legislatiu’e ; And whereas it is desirable that such sanction should be given, and that tlie remainder of the land sliould lx; sold by public auction as hereinafter provided : Pe it therefore enacted by the Queen’s Most Excellent Majesty, by and with tbc advice and consent of the Legislative Council and Legislative Assembly of New South AVales in Parliament assembled, and by the authority of the same, as follows ;—^

1. This Act may be cited as the “ AVollongong Public Scliool short uuo.

Provided that so much of the said land as is contained in lots numbered one to seven inclusive in the subdivision of the said land, as described in the Eirst Schedule hereto, being tlie portion sold by the Government for the consideration of five pounds to the Municipal Council of the Borough of AVollongong, shall be vested in the said

Council for an estate of inheritance in fee-simple in possession, hut Avithout prejudice to any trusts and purposes, express or implied, for, or subject to Avhich the said portion was acquired hy such Council.

SCHEDULES.

FIEST SCHEDULE.

Commencing at tlie intersection of tlio east side of Kembla-strect with the south side of Crown-street; and bounded thence on the north by that side of lastmentioned street bearing south eighty-nine degrees one minute east one hundred and forty-one feet ten and one-half inches ; thence on the east by the west boundary of allotment eight bearing south fifty-nine minutes west one hundred and twenty feet; thence on the south by a line bearing north eighty-nine degrees one minute west one hundred and forty-two feet six inches to the east side of Kembla-street aforesaid ; and thence on the west by that side of that street bearing north one degree nineteen minutes east one hundred and twenty feet to tlie point of commencement. •

SECOND SCHEDULE.

Commencing on the south side of Crown-street at the north-east corner of allot­ ment seven, being a point bearing south eighty-nine degrees one minute east, and distant one hundred and forty-one feet ten and a half inches from the intersection of tbe east side of Kembla-street with the south side of Crown-street; and bounded tlienco on part of the north by that side of that street bearing south eighty-nine degrees one minute east one hundred and twenty feet; thence on the east by a line bearing south one degree thirty-seven minutes west three hundred and thirty- seven feet six inches to the north side of Burelli-street; thence on the south by that aide of that street bearing north eighty-nine degrees twenty-four minutes west two hundred and sixty feet to the east side of Kembla-street; thence on part of the west by that side of that street bearing north one degree nineteen minutes east two hundred and nineteen feet one inch; thence on the remainder of the north by a lino forming the south boundaries of allotments one to seven bearing south eighty-nine degrees one minute east one hundred and forty-two feet six inches ; and thence on the remain­ der of the w'est by a line forming the east boundary of allotment seven aforesaid bearing north fifty-nine minutes east one hundred and twenty feet to the point of commencement.
