1940 Wivenhoe Dam and Hydro - electric Works Act Amendment Act 1989, No. 113 BE IT ENACTED by the Queen's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows:- 1. Short title. This Act may be cited as the Wivenhoe Dam and Hydro-electric Works Act Amendment Act 1989. 2. Citation . (1) In this Act, the Wivenhoe Dam and Hydro-electricWorks Act 1979-1984 is referred to as the Principal Act. (2) The Principal Act as amended by this Act may be cited as the Wivenhoe Dam and Hydro-electric Works Act 1979-1989. 3. Commencement . (1) Sections 1 and 2 and this section commence on the day on which this Act is assented to for and on behalf of Her Majesty. (2) Except as provided by subsection (1), this Act commences on a day appointed by Proclamation. 4. Amendment of s.36 . Section 36 of the Principal Act is amended by deleting subsections (2) to (4) and substituting the following subsections:- "(2) Land taken or acquired for the purposes of the Wivenhoe dam project being- (a) land situated on Wivenhoe Hill above the full supply level of Wivenhoe dam and specified in the schedule; or (b) land, other than land specified in the schedule, specified by the Governor in Council by Order in Council, is, upon the making of an Order in Council by the Governor in Council, vested in the Brisbane and Area Water Board as trustee for the following purpose or purposes as specified in the Order in Council, namely- (c) (i) environmental parks; (ii) parks, gardens and recreation grounds; (iii) scenic purposes; (iv) other like purposes, within the meaning of the Land Act 1962-1988; or (d) such purpose declared in that Order in Council. (3) Notwithstanding the trusts created by and under subsection (2) the trustee of the land to which that subsection refers may dedicate to public use as road such part or parts of the land as is thought fit and, if the case requires it, surrender to the Crown such part or parts for that purpose and any road thereon may be closed permanently or temporarily as provided by law.
Wivenhoe Dam and Hydro-electric Works Act Amendment Act 1989, No. 113 1941 (4) Notwithstanding the trusts created by and under subsection (2), the trustee of the land to which that subsection refers may, for such period of time and subject to such terms as may be approved by the Governor in Council by Order in Council, lease all or part of such land for a purpose or purposes in accordance with subsection (2). (5) Where land vested in the Brisbane and Area Water Board pursuant to subsection (2) consists of an estate, right, title or interest that is recorded in the registers kept by the Registrar of Titles or the Registrar of Dealings or in any other registers, the registrar or other person charged with keeping such register is hereby authorized, upon being satisfied as to the land specified in the schedule or to which the Order in Council relates, to cause, without fee or charge, all necessary entries to be made in the appropriate registers to record the vesting of such land in the Brisbane and Area Water Board.". 63
