The Parliament of Australia enacts:
(1) This Act may be cited as the
Wine Research Repeal Act 1986 .(2) The
Wine Research Act 1955 is in this Act referred to as the Principal Act.
(1) Subject to subsection (2), this Act shall come into operation on the day on which it receives the Royal Assent.
(2) Section 5 shall come into operation on a day to be fixed by Proclamation, being a day after the day on which the last payment is made under section 4.
Section 6 of the Principal Act is repealed.
(1) Where there is established a Research Fund within the meaning of the
Rural Industries Research Act 1985 into which amounts equal to the amounts from time to time received by the Commonwealth under legislation making provision for the collection of the levy imposed by theGrape Research Levy Act 1986 or by theWine Grapes Levy Act 1979 as the research component of that levy is payable, then, as soon as is practicable after the establishment of that Research Fund, the amount of $300,000 shall be paid out of the Fund into that Research Fund for the purpose of grape research.(2) On such day as the Minister determines, there shall be paid to the Institute out of the Fund:
(a) if payment under subsection (1) has been made—the balance of the money standing to the credit of the Fund; or
(b) in any other case—the difference between the amount of the money standing to the credit of the Fund and $300,000.
(3) If payment under subsection (1) is made after payment under subsection (2), then, as soon as is practicable after the making of the payment under subsection (1), the balance (if any) of the money standing to the credit of the Fund shall be paid to the Institute out of the Fund.
(4) In this section
Fund andInstitute have the same meanings respectively as they have in the Principal Act.
The following Acts are repealed:
Wine Research Act 1955
Wine Research Amendment Act 1980.
