REGULATIONS UNDER THE WINE OVERSEAS MARKETING ACT
1929-1945.*
I, THE GOVERNOR-GENERAL in and over the Commonwealth of
Australia, acting with the advice of the Federal Executive Council, hereby make
the following Regulations under the WineOverseasMarketingAct 1929-1945.

Amendments of the Wine Overseas Marketing (Staff) Regulations.
Definitions.
1. Regulation 3 of the Wine Overseas Marketing (Staff)
Regulations is amended by omitting the definition of “standard salary”.
2.—(1.) Regulation 4 of the Wine Overseas Marketing
(Staff) Regulations is repealed and the following regulation inserted in its
stead:—
Salaries of officers.
“4.—(1.) An officer who occupies an
office specified in column 1 of Table A is entitled to the annual salary, or
salary within the limits of salary, specified in column 2 of that Table
opposite to that office and to the increments of salary within those limits
specified in column 3 of that Table.
“(2.) An officer is not entitled to an
increment of salary until he has received salary without the increment for not
less than twelve months.
“(3.) The salary of an officer under this
regulation shall be subject to variation from time to time in accordance with
the provisions of regulation 106a of the Public Service Regulations as
inserted by Statutory Rules 1951, No. 77.
“(4.) The salary and allowances (if any)
of an officer stationed in London shall be paid in English currency.”.
(2.) This regulation shall be deemed to
have come into operation on the thirtieth day of June, 1951.

3.—(1.) Regulations 4a to 11, inclusive, of the Wine Overseas Marketing
(Staff) Regulations are repealed and the following regulation is inserted in
their stead:—
Conditions of
employment of officers.
“5.— (1.) Subject to these Regulations,
officers shall be employed under the same conditions with respect to leave of
absence and holidays as those prescribed in relation to officers of the
Commonwealth Public Service by the Commonwealth Public Service Act 1922-1948, or by that Act as amended, and
under the same conditions with respect to attendance, performance of duties,
hours of duty and overtime payment, and travelling and other allowances as
those prescribed in relation to officers of the Commonwealth Public Service by
the Commonwealth Public Service Regulations.
“(2.) Where the Board certifies that the
functions and duties of an officer, or officers included in a class of
officers, employed by the Board are substantially similar to those of an
officer, or officers included in a class of officers, in relation to whom a
determination under the Arbitration (PublicService) Act 1920-1947, or under that Act; is amended,
specified in the certificate makes provision with respect to a matter specified
in the last preceding sub-regulation, that officer, or the officers included in
that class of officers, employed by the Board shall be employed under the same
conditions with respect to that matter as are prescribed by the determination.
“(3.) Where a condition of employment
prescribed by sub-regulation (1.) of this regulation is inconsistent with a
condition of employment prescribed by sub-regulation (2.) of this regulation,
the latter shall prevail and the former shall, to the extent of the
inconsistency, not apply to, or in relation to, officers.
“(4.) For the purposes of this
regulation, a reference in the Commonwealth Public Service Act 1922-1948, or in that Act as amended, the
Commonwealth Public Service Regulations or a determination under the Arbitration (PublicService) Act 1920-1947, or under that Act as amended, to the
Public Service Board, the Permanent Head or the Chief Officer shall be read as
a reference to the Chairman of the Australian Wine Board.”.
(2.) This regulation shall be deemed to
have come into operation on the twenty-ninth day of December, 1949.
Travelling
allowance.
4.—(1.) Regulation 12 of the Wine Overseas Marketing
(Staff) Regulations is amended by omitting sub-regulation (1.) and inserting in
its stead the following sub-regulation:—
“(1.) Where the Overseas Representative
or the Assistant Overseas Representative is required, for the purpose of the
business of the Board, to travel or to reside temporarily at a place other than
his usual place of residence, he shall, be paid travelling allowance in
accordance with Table B.”.
(2.) This regulation shall be deemed to
have come into operation on the twenty-ninth day of December, 1949.
Cost of transport to overseas destination.
5—(1.) Regulation 12a of the Wine Overseas Marketing (Staff) Regulations is
amended by omitting sub-regulation (1.).
(2.) This regulation shall be deemed to
have come into operation on the twenty-ninth day of December, 1949.
Entertainment expenses.
6.—(1.) Regulation 13 of the Wine Overseas Marketing
(Staff) Regulations is amended by omitting the words “Two hundred pounds” and
inserting in their stead the words “Two hundred and fifty pounds”.
(2.) This regulation shall be deemed to
have come into operation on the fourth day of May, 1951.
The Schedule.
7.—(1.) The Schedule to the Wine Overseas (Staff)
Regulations is amended—
(a) by omitting Table A and inserting in its
stead the following Table:—

(2.) The amendment of the Wine Overseas
Marketing (Staff) Regulations effected by paragraph (a) of the last preceding sub-regulation
shall be deemed to have come into operation on the thirtieth day of June, 1951,
and the amendment effected by paragraph (b) shall be deemed to have come into
operation on the twenty-ninth day of December, 1949.
Salaries of
officers during certain period.
8.—(1.) Notwithstanding anything contained in the Wine
Overseas Marketing (Staff) Regulations as in force during the period which
commenced on the twenty-ninth day of December, 1949, and ended on the
twenty-ninth day of June, 1951, an officer of the Board who occupied the office
specified in column 1 of the table in this sub-regulation shall, in respect of
her service during that period, be deemed to have been entitled to the annual
salary, or salary within the limits of salary, specified in column 2 of the
table and to the increments of salary within those limits specified in column 3
of that table.

(2.) The salary to which an officer of
the Board is deemed to have been entitled under the last preceding
sub-regulation during the period specified in that sub-regulation shall be
deemed to have been subject to variation from time to time in accordance with
the provisions of regulation 106a of the Commonwealth Public Service
Regulations as in force during that period.
