An Act to authorise the Council of the Municipality of Windsor to convey and transfer certain lands within the said Municipality in exchange for certain other lands; to amend the Local Govern ment Act, 1919; and for purposes connected therewith. [Assented to, 16th November, 1971.]

| Preamble. | wHERE AS: | (1) Hobartville Developments Pty. Limited and its predecessors in Title have been and are the regis tered proprietors of certain lands situate within the Municipality of Windsor (the Council whereof is hereinafter referred to as “the Council” ) being the whole of the land contained within Lot 1 in Deposited Plan 218126: |
| (2) By the registration of Deposited Plan 231320 certain land bounded in part by Laurence Street and Luttrell Street, Richmond, having an area of nineteen acres two roods twenty-one and three- quarter perches and being the land marked as Public Reserve in that Deposited Plan was vested in the Council in fee simple as a public reserve: | ||
| (3) The said Council has since held the said land for |
the purpose of providing a public reserve:
(4) In the interests of obtaining a more balanced sub division the Council is willing to transfer to Hobart ville Developments Pty. Limited a part of the said public reserve being the areas described in the First Schedule hereto and having a total area of eight acres three roods eighteen and one-half perches:
(5) In exchange for the transfer of the said areas described in the First Schedule hereto Hobartville Developments Pty. Limited is willing to transfer to the Council or dedicate in favour of the Council certain lands totalling in area twelve acres one and one-half perches and being more particularly described in the Second Schedule hereto:
(6) The Council has no authority under the Local Government Act, 1919, to transfer any part of a public reserve within the meaning of that Act:

BE it therefore enacted by the Queen’s Most Excellent Elizabeth i l
Majesty, by and with the advice and consent of the Legislative
Council and Legislative Assembly of New South Wales in
1. This Act may be cited as the “Windsor Municipal Snort title.
Council (Hobartville Public Reserve) Act, 1971”.
2. The Council of the Municipality of Windsor is hereby Exchange of
authorised and empowered to convey and transfer the lands between described in the First Schedule hereto in fee simple freed and Windsor discharged from all trusts estates or interests affecting the
same to Hobartville Developments Pty. Limited subject to the said Hobartville Developments Pty. Limited transferring to the said Council of the Municipality of Windsor in fee simple freed and discharged from all trusts estates or interests the lands described in the Second Schedule hereto which last- mentioned lands shall thereupon be held by the Council for public reserves within the meaning of the Local Government Act. 1919.
