334 PARKS AND PUBLIC LANDS-SCHOOLS OF ARTS. Wilston School of Arts, Property Etc., Act. 7 GEO. VI. No. 7, Government of Queensland or the Commonwealth of Australia, but every such investment shall be made with due regard to the purpose for which the fund is to be expended and the income from every such investment shall be paid into and form part of the fund. SCHEDULE. All that piece or parcel of land situated in the county of Merivale, parish of Warwick, city of Warwick, containing 4 acres 3 roods 8 35/100 perches, be the same more or less, being subdivision I of suburban allotment 2, resubdivision 2 of subdivisions II and 12 and resubdivision 2 of subdivision 16 of suburban allotment I of section 44 on Plans Catalogue Nos. 45819, 46789, and 46790, deposited in the Office of the Registrar of Titles, Brisbane, which said piece or parcel of land is the whole of the land ·described in Certificate of Title No. 334090, volume 1787, folio 80. [ASSENTED TO 8TH APRIL, 1943.] Preamble. Schedule. W HEREAS certain land enumerated in the Schedule was demised by lease during the year one thousand nine hundred and seventeen by the then Council of the town of Windsor to an association or institution known as the Wilston School of Arts, for a period of ninety-nine years, at a peppercorn rental when demanded, and it was covenanted in the instrument of lease that the premises to be erected upon the said land were to be used as a school of arts and public hall and for no other purpose: And whereas a public meeting was subsequently held and moneys were raised sufficient to cover the erection of a public hall, and an institution styled the Wilston School of Arts. came into being with rules and regulations governing its constitution:

Tipping, and P. Henderson: And whereas the said T. Gardiner having died, the said E. C. Tipping having resigned, there is only one trustee, P. Henderson remaining: And whereas the area of the town of Windsor was pursuant to *" The Oity of Brisbane Act of 1924," abolished as from the first day of October, one thousand nine hundred and twenty-five, and from that date all members of the Windsor Town Council went out of office, and the said area incorporated in the area of the City of Brisbane, and governed by Brisbane City Council : And whereas Brisbane City Council have reported to the Government that an unsatisfactory position obtains in respect to the school of arts, and that it was recommended by the said Council that an Act be passed vesting the said school of arts in the said Council or other trustees: And whereas it is considered desirable that the said Wilston SchoolofArts be vested in Brisbane City Council- Be it therefore enacted by the King's Most Excellent Majesty, by and with the advice and consent of the Legislative Assembly of Queensland in Parliament assembled, and by the authority of the same, as follows : - 1 This Act may be cited as " The W ilston School of Short title. Arts Property Vesting Act of 1943." 2. In this Act, unless the context otherwise indicates, Definitions. the following terms have the meanings set against them respectively, that is to say:- "Brisbane City Council "-The Brisbane City B~ bane Council constituted pursuant to the City ofg: ~cil. "Wilston School of Arts "-The demise of the land described in the Schedule, and referred to in the preamble with all buildings and permanent improvements situated thereon. Vesting of Wilston School of Arts in Brisbane City Council. Trustee to give peaceable possession. 3. (1.) From and after the commencement of this Act,- (a) The Wilston School of Arts, and all other property and assets of whatever description, and wherever situated, which is or may be vested in or held by or in the name of the trustee, or otherwise or in the name of any other person for or on behalf of the trustee or of the Wilston School of Arts ; (b) All instruments, documents, records, plans, correspondence, and all books and writings, and all rights, liabilities, obligations, contracts and engagements, in regard to or appertaining to the matters and things referred to in paragraph (a)- shall, without any transfer, assignment, conveyance or notice other than this Act be divested from every such person or persons as aforesaid, and are hereby conveyed, handed over, transferred to and vested in, and shall attach to and may be enforced by and against Brisbane City Council. (2.) The trustee, or any other person referred to in subsection (1) of this section shall and is hereby required to give peaceable possession of the Wilston School of Arts, and all such property and assets and all such matters and things as above referred to to Brisbane City Council or to the Town Clerk or other officer authorised by the said Council to receive same on its behalf. (3.) The receipt by the Town Clerk, or other authorised officer of Brisbane City Council of such property and assets and all such matters and things shall be a good and sufficient discharge, and the trustee shall not thereafter be liable or accountable therefor or bound to see to the application or appropriation thereof. Management 4. (1.) The Brisbane City Council shall have the ~ f~~ : - ~ l management and control of the Wilston School of Arts School of and of the affairs and concerns thereof, and may act in Arts. all matters therein in the manner as appears to it best calculated to promote the interests thereof.

The Brisbane City Council may appoint a secretary and/or caretaker who shall exercise and perform such duties as shall be directed by the said Council. 5. [ASSENTED TO 19TH NOVEMBER, 1942.] ~ XTHEREAS it is desirable that real and personal Preamble. \' \' property which belongs now or may hereafter belong to the United Grand Lodge of Antient Free and Accepted Masons of Queensland, or Lodges subject thereto, should vest in and be managed by Trustees, and that on any change in the trusteeship becoming necessary the title to such property should devolve without the expense of conveyance or transfer being incurred: And whereas it is necessary to obtain power and authority for providing for the due succession of trustees without conveyance or transfer, and for creating facilities of proof:
