1      Name of Plan

This Plan is Willoughby Local Environmental Plan 2012 (Amendment No 6).

2      Commencement

This Plan commences on the day on which it is published on the NSW legislation website.

3      Land to which Plan applies

This Plan applies to land at 17 Smith Street, Chatswood, being Lot 101, DP 714477.

4      Amendment of Willoughby Local Environmental Plan 2012

Schedule 1 Additional permitted uses

Insert at the end of the Schedule with appropriate clause numbering:

Use of certain land at 17 Smith Street, Chatswood

(1)

This clause applies to land at 17 Smith Street, Chatswood, being

Lot 101, DP 714477.

(2)

Development for the purposes of a supermarket or a supermarket and

liquor store is permitted with development consent.

(3)

Development consent under subclause (2) must not be granted unless

the consent authority is satisfied that:

(a)

the floor space ratio of that part of the building on the site that is to be used for the purposes of the proposed development will not exceed 1.1:1, or

(b)

the gross floor area of that part of the building on the site that is

to be used for the purposes of the proposed development will not

exceed 4,815m2.
