GLEESON CJ:   This appeal was heard in Canberra on 17 June 1999 by a Court comprising Justices McHugh, Gummow, Kirby, Hayne and myself.  The Court is in a position now to pronounce its order.  Reasons for judgment will be published later.  The order of the Court is:

1.  Appeal allowed with costs.

2.  Set aside the orders and declaration of the Full Court of the Federal Court of Australia made on 6 July 1998 and in place thereof order that the appeal to the Full Court be dismissed with costs.

The effect of this order is to discharge the undertaking and stay which were continued until the determination of the appeal on the grant of special leave on 9 October 1998. 

I publish the order of the Court.
