Wildlife (Game) (Amendment) Regulations 2000

The Governor in Council makes the following Regulations:

1. Objective

The objective of these Regulations is to regulate the use of shot in the hunting of ducks and generally in State Game Reserves.

2. Authorising provision

These Regulations are made under section 87 of the Wildlife Act 1975.

3. Commencement

These Regulations come into operation on

1 March 2000.

4. Principal Regulations

In these Regulations the Wildlife (Game) Regulations 19901 are called the Principal Regulations.

5.  Definitions

In Regulation 5 of the Principal Regulations—

(a)

after the definition of "Open Season" ' "possession" in relation to shot includes

any of the following—

(a) physical possession of the shot;

(b) custody or control of the shot;

(c)

access to the shot either solely or in common with others;'.

(b)

after the definition of "Secretary" insert— ' "State Game Reserve" means an area

classified as a State Game Reserve

under section 15 of the Act;';

(c)

after the definition of "take" insert— ' "toxic shot" means shot which is not of a

class or type described in the Seventh

Schedule;';

6. Insertion of new regulation 16A

After regulation 16 of the Principal Regulations insert—

"16A. Use of toxic shot

(1) A person must not—

(a) use toxic shot to hunt or take ducks; or

(b) be in possession of toxic shot—

(i) in the course of hunting ducks; or

(ii)  within an area in which he or she intends to hunt ducks; or

(iii) within a State Game Reserve.

Penalty: 20 penalty units.

(2) Sub-regulation (1) does not apply in the

following circumstances—

(a) when a person is in possession of toxic shot while hunting or intending to hunt quail in an area specified in Schedule 2 of the Wildlife (State Game Reserve)

Regulations 1994; or

(b) in any period from 1 January 2000 to 31 December 2000 when a person is hunting or taking or intending to hunt
or take ducks in the open season for
duck—

(i)  in an area other than a State Game Reserve; or

(ii)  if the person is using a shotgun with a gauge of less than 12; or

(c)

in any period from 1 January 2001 to 31 December 2001 when a person is hunting or taking or intending to hunt

or take ducks in the open season for
duck—
(i)

in an area other than a State Game to duck hunting; or

(ii)  where the person is using a shotgun with a gauge of less than 12.".

7. Insertion of new Schedule

After the Sixth Schedule to the Principal

Regulations insert—

"SEVENTH SCHEDULE
Wildlife (Game) (Amendment) Regulations 2000

SHOT WHICH IS NOT TOXIC SHOT

Shot commonly known by the description set out in Column 1 and
constituted by weight as described in the corresponding part of

Column 2

Steel (a) at least 98 per cent iron; and

(b)

not more than 1 per cent each of any other element.

Bismuth

(a) at least 96 per cent bismuth; and (b) not more than 4 per cent tin; and

(c)

not more than 1 per cent of any other element.

Tungsten–Matrix (a) at least 86 per cent tungsten; and
(b) not more than 5 per cent nickel; and
(c) not more than 3 per cent iron; and

(d)

not more than 3 per cent ethylene methacrylic acid copolymer; and

(e)

not more than 1 per cent of any other element or compound.

Tungsten–Iron (a) at least 45 per cent iron; and
(b) not more than 55 per cent tungsten; and

(c)

not more than 1 per cent of any other element.

Tungsten–Polymer (a) at least 93 per cent tungsten; and

(b)

not more than 7 per cent Nylon 6 or Nylon 11; and

(c)

not more than 1 per cent of any other element or compound.

Tin (a) at least 98 per cent tin; and

(b)

not more than 1 per cent of any other element.".
