Wildlife Amendment (Restricted Wildlife) Regulations 1998

I, the Lieutenant-Governor in and over the State of Tasmania and its Dependencies in the Commonwealth of Australia, acting with the advice of the Executive Council, make the following regulations under the National Parks and Wildlife Act 1970 .13 July 1998

1Short titleThese regulations may be cited as the Wildlife Amendment (Restricted Wildlife) Regulations 1998 . 2CommencementThese regulations take effect on the day on which their making is notified in the Gazette. 3Principal RegulationsIn these regulations, the Wildlife Regulations 1971 are referred to as the Principal Regulations. 4Regulation 2 amended (Interpretation)Regulation 2(1) of the Principal Regulations is amended by inserting after the definition of "process of treatment" the following definition: restricted wildlife means the forms of wildlife specified in Schedule 2C; 5Regulation 10A insertedThe following regulation is inserted after regulation 10 of the Principal Regulations: 10ARestricted wildlife A person must not buy, sell or have possession of any form of restricted wildlife or any product of any form of restricted wildlife unless that person is authorised to do so by a permit. 6Regulation 28 amended (Offences)Regulation 28 of the Principal Regulations is amended by inserting after subregulation (5) the following subregulation: (5A)  On being convicted of an offence of buying, selling or having possession of a creature that is a form of restricted wildlife, the offender is liable to a fine not exceeding 50 penalty units. 7Schedule 2C insertedAfter Schedule 2B to the Principal Regulations, the following Schedule is inserted: Schedule 2CRestricted wildlife
