WILD DOG DESTRUCTION ACT 1921—REGULATION

(Wild Dog Destruction Regulation 1994)

HIS Excellency the Governor, with the advice of the Executive Council, and in pursuance of the Wild Dog Destruction Act 1921, has been pleased to make the Regulation set forth hereunder.

Citation

1. This Regulation may be cited as the Wild Dog Destruction

Regulation 1994.

Commencement

2. This Regulation commences on 26 August 1994.

Definitions

3. ( 1 ) In this Regulation:
“the Act” means the Wild Dog Destruction Act 1921.

(2) In this Regulation, a reference to a Form is a reference to a Form

set out in Schedule 1.

Annual rates: sec. 12

4. For the purposes of section 12 (1A) of the Act, the maximum annual rate that may be imposed and collected on land within the Western Division is, in respect of the year 1994 and each subsequent year, 3 cents per hectare.

Interest on overdue rates: sec. 12A

5.   (1) The object of this clause is to prescribe the rate per cent per year

to be used in calculating the sum by which overdue rates are to be
increased in accordance with section 12A of the Act.

(2) The rate per cent per year prescribed for the purposes of section 12A (2) of the Act is the rate for the time being prescribed under section 95 (1) of the Supreme Court Act 1970 for payment of interest on a judgment debt.

6. For the purposes of section 14 (1) of the Act, the prescribed form of

rate notice is Form 1.

Repeal

7. (1) The Wild Dog Destruction Regulation 1980 is repealed.

(2) Any act, matter or thing that, immediately before the repeal of the Wild Dog Destruction Regulation 1980, had effect under that Regulation is taken to have effect under this Regulation.

SCHEDULE 1—FORMS

EXPLANATORY NOTE

The object of this Regulation is to repeal and remake, with minor changes, the provisions of the Wild Dog Destruction Regulation 1980 under the Wild Dog Destruction Act 1921. The new Regulation deals with the following matters:

(a)

the rates that may be imposed and collected under the Act on land within the Western Division (clause 4);

(b)

the amount by which rates may be increased after they have become overdue (clause 5);

(c) the form in which rate notices are to be issued (clause 6);

(d) citation, commencement and other formal matters (clauses 1, 2, 3 and 7).

This Regulation is made under the Wild Dog Destruction Act 1921, including section

31 (the general regulation making power) and sections 12, 12A and 14.

This Regulation is made in connection with the staged repeal of subordinate

legislation under the Subordinate Legislation Act 1989.
